Hey everyone, I am having issues getting a refund on a item that was sold to me that was much different than pictured. The seller outright used pictures of another brand and when I opened a case they ended the listing and put up a new one with the actual item pictured. I guess this was enough for eBay to decline my return? If anyone can point me to where I can speak to a real person at eBay that can help me resolve this (since it seems they want to make it harder every time to do so). It’s really unacceptable that sellers can get away with ripping off users on this site.

Also how does a seller get a negative feedback removed especially if it’s accurate? I kind of understand if it’s returned or the buyer outright lies but if not?

The only 'typical' way a buyer is denied a 'Not as Described' return, is when that terminology has been abused and reported as such, previously.
Have you had many NAD returns?
Did you open a case (return) for NAD?
At what point was it 'denied'? (immediately? over time)
Did you 'escalate'?
Neg feedback can be removed by Top Rated Plus sellers with Free Returns. Did this buyer have free returns, buyer pay returns or no returns?

Did the buyer offer returns? If not then embrace whatever item you now own and warn others via bad feedback what they are doing.

I recommend finding auctions that say you will get exact item in the picture. Otherwise people use 1 picture and sell 600 of them all in different condition.

Unfortunately @asc_tx what you've described is impossible but regardless, you've come to the end of the road with regular eBay customer support.
Instead, reach out with hand sanitizer to eBay on Facebook here, and tell eBay in a private message that your return was declined because the seller replaced the listing afterwards, to get your refund.

Was the case you opened a return request? What was the reason given for the return? Most return approvals or denials or done by a bot so they are based on the reason the buyer uses for a return.
If ebay looks at the listing to see what it says, they would look at the listing as it was when you made a purchase, not at any changes made afterwards.

Is there some information that's missing? You opened an item not as described case, and then what?
Did you return to the case 96 hours after opening it and ask eBay to step in?

Maybe you didn't know this, but all listings implicitly state that you will receive the exact item you see in the picture. If that does not happen, the buyer is protected by the MBG.
