Has anyone had an item returned damaged , I then filed a claim with ebay filed all the proper paperwork
they denied my claim refunded the buyer and now will not give me back the 12.9% they charged me

It happens and there's not much you can do but refund the buyer and toss the item in the trash.
You should have refunded the buyer, before you got Ebay involved.

A bit confusing... what type of 'claim' did you open with eBay? An appeal after the refund was issued?

You probably have an unresolved claim defect as well.
Ebay wants sellers to settle claims without being asked to step in. Once you ask them to step in and make a decision, if they rule in favor of the buyer your fvf are not refunded.
There are some situations when a seller can hold back up to 50% of the refund but the seller must be a trs that offers at least 30 day returns. Non trs sellers who offer free returns can also hold back some of the refund when an item is returned damaged.

Did you 'accept the return' when the buyer filed the 'return request'? If you did ... then you should have gotten your fees refunded.
If you waited for the buyer to bring eBay into the case ... OR you asked eBay to step in yourself ... then eBay will withhold your fees for doing your work for you.
