Seller sold me a fake item. I request a return. After much hassle, this guy accepts the return BUT refuses to send me return postage label which he is required to do by selling a fake item advertised as authentic. The return (and my refund) can't go forward until the item is shipped (as I understand it). Furthermore the address he wants the item returned to is not the return address on the package. Do I just mark the item as shipped and just not send it? Of course I am unable to get an Ebay service rep on the phone to get their take.

As long as you requested the return due to "item not as described" the seller is required to send you a label. If they don't do so within a specified period of time (not sure if it's 4 days or something??) go back to the return case and click on "ask eBay to step in". They will send the label and charge the seller and you will get your refund once it's returned.

Do not talk to the seller again @lhillman and there's no need to discuss any of this with eBay customer support. When a seller
-- has accepted a return,
-- is responsible for return shipping,
-- but does not issue a prepaid return label
eBay will invite itself to step in after 2 business days (ahead of the usual 3 business days) to force a return label. So just go silent now, and wait for eBay to pounce.

No on both counts.
The return address must be the same identical address as from where you originally ordered the item -- sending it to another address may put your return claim in jeopardy.
Definitely do NOT marked the return as "shipped," if you have not yet shipped it -- and don't ship it out until you have received a LEGITIMATE return label from the seller, generated through eBay.

If the seller is paying for return shipping and would like to have the item delivered to a different location, they are more than welcome to make this decision. Additionally, if a seller buys a label without tracking information, we would only need proof that the buyer shipped the item to protect them.

Did you open a return address for one of the "not as described" reasons?
Or did you just contact the seller requesting to return the fake item?
if it's the latter, go to the order and open a return request.

That's covered in the eBay MBG for buyers. I can explain it to you but I can’t understand it for you.

Here is another complication: I am leaving h the USA today and going to be overseas until early in January. The item is supposed to be returned by December 19 according to EBay. If the return label comes while I am gone and I am unable to send it by December 19, do I lose my right to a refund?

When I ask Ebay to step in, they give me one of two options: Contact the seller OR Mark item as shipped. It does no good to contact the seller (I have requested a shipping label more than once) and I cannot mark the item as shipped because of no shipping label. I am leaving the USA in hours for some travel overseas and won't be back until January 7th. Ebay says the item must be returned by December 19th. I don't know what to do .

Am confused here. Since the OP states the seller is located in Hong Kong, doesn't that mean the seller cannot actually send a return label and is required to reimburse the buyer in advance for the projected cost of returning the item?

OP here. I don’t know where the buyer is from. The return address on the package is from NJ but who knows?

Do not talk or respond to the seller again. Leave a private message here for eBay on Facebook, or open an account just to contact eBay, from anywhere in the world or from outer space. Be brief, avoid tangents, and don't mention that you're traveling.
Tell eBay that the seller has not provided a prepaid return label. eBay will put the case on hold for 5 days for the seller to either send cash upfront to buy the return label, or just refund outright with no return needed.
After that @lhillman if the seller does nothing or neither, eBay will force a refund with no return needed, all while you're elsewhere in the world.

Can you pack the item and give it to a neighbor or relative that has a printer? IF the seller sends you the shipping label, you can forward it to your friend/relative. They print it and drop off the package at the post office. Otherwise, you are stuck with this item. Either sell it, toss it or donate it when you come back.
