I ordered a left driver rear tail light lamp for my husband. When we received the part it was for the right side and not the left side. We went through the process of receiving an authorization for return, we took photos of the part and the serial number label and posted the photos with the return request. When the seller received it, he opened a case with eBay against me saying that I sent back the incorrect part. He claims he sold the right side previously so basically, he sent me the left side, and it didn't make sense to him that we received the right side. I informed him that we returned what we received with photos. Ebay has opened a case, but it has been a over a month and I have not heard anything from them as to the resolution. My husband said we do not have to have the refund as long as he ships the correct part to us. Have not heard back yet. What should I do if the seller is against shipping the correct part or giving a refund?

Sellers cant open cases. If its been over a month, the case has timed out and Ebay closed it. you should have asked Ebay to step in and you would have been refunded. If you paid by cc, try them for a chargeback.

eBay allowed the seller to open a case against me and would not allow me to request them to step in on my behalf.

Sellers cannot open cases against buyers, do you mean the seller reported you? What kind of case did you open? If it was for item not received, thats wrong, it should have been item not as described. If you opened item not received, Ebay would have closed the case, since you did receive something. See if you can go back and open an item not as described case, if the seller does not respond within four days, ask Ebay to step in, the button will appear.
Are you still within the thirty day MBG?

Do not try to get the correct part from the seller, and don't contact eBay nor the seller again.
Instead, before another month passes and before your deadline passes, file a CREDIT NOT PROCESSED chargeback with your card issuer, provide the return tracking number, and get your refund.
Why Would a Customer File a Chargeback With Reason Code �Credit Not Processed?�
�Credit Not Processed� chargebacks are filed by customers who have returned their purchase but did not receive a refund from the merchant.
Then after you get your refund @dvkzkrafts buy the correct part from another seller.

Should have filed a return case with eBay regardless of what a seller states and let eBay handle it. You have 30 days from delivery.
