Seller arguing that the item is not counterfeit

I recently bought some open-box airpods pro and I was already a little suspicious about the price but I was like maybe why not? The item arrived was fake with a printed serial on it, and ANC doesn't work, the AirPods don't show serial number on settings etc. I took it to Apple and they said the item is not by Apple unless I have some form of proof of purchase to show. I am pretty sure the item is fake and the seller will not have any proof of purchase so I asked him to return it, now he does not want to take the return or give the money back and has no proof to show that the AirPods are real either. When I claim something they say, "You can claim false things, but I have talked to eBay and they will take care of it". Can eBay listen to a seller like that? I have no written documentation that says it is fake (since Apple doesn't do that as far as I know) but I have several other visual proofs that the airpods are fake and I want to even return it for a full refund. What are the chances I will get the money back from the money-back guarantee policy?

Go to the order in your ebay, click on the arrow and choose to return this item, picking the reason as either not authentic or not as described. 

 

The seller will have to respond by either accepting the return by paying for a return shipping label or by issuing a refund without requiring you to return the item.

 

If he sends a label, you return the item and once tracking shows delivery, you should get your refund from the seller but if the seller doesn't issue it, you can go to the return and ask ebay to step in.

 

If the seller doesn't respond with either a label or a refund, you can wait 3 days and go back to ask ebay to step in.

Understand that you must follow the MBG procedure. Sending back-and-forth messages to the seller is NOT the correct procedure.

Since they do not work right, return as not working.   You are covered.

 

Watch out and avoid those too good to be true listings.  They always are...........

I assume you got the AirPods like yesterday or today in the mail, since your account was made on the 11th and shipping would have been done in a 5 day window of delivery. So, I can assume they were purchased in the continental USA. And I assume you went to an Apple Store yesterday or today since delivery was this week.

So, my Air pods from an Apple Store which I purchased and do say on the outside  Air Pod Holder "Designed by Apple in California....& Assembled in Vietnam"....I never looked at mine till today and saw it was made in Vietnam.

However, the inside of my real pod has a serial number.

I have also bought cheap AirPods before...very cheap...and they never have shown any serial numbers on settings...as well as my real AirPods do not show serial numbers on settings.

And living in San Francisco(with the Apple techs) and an Apple Store would never ask for a receipt to answer any questions about an Apple product. They would say if it was real or not without a receipt. Any employee or any Apple Store can tell you if they are real or not. And they fix Apple products for free in all Apple stores, by the way. And you usually have to make an appointment to have an item checked out.

Your time frame just doesn't add up for all of this...Just my own opinion.

Have you read the eBay Money Back Guarantee for buyers?

You apparently received an item that's not as described.  You go to the item in your buying history and open an "item not as described" case.

No need for any back-and-forth dialogue with the seller.
