Hello Everyone,
I bought a pair of sunglasses with a seller based in Italy. Prior to purchasing, he confirmed to be that the sunglasses were in good condition, new and without scratches.
When it came however, the lenses were scratched and later i also noticed that one arm was loose because it was missing part of the screw.
Long story short, I requested for a return which was filed under' Doesnt match description or photos' on 19 December. The seller has a no return policy and declined the return today. The case is closed.
I thought the 'Doesnt match decription' cases overules the seller no return policy?
Weirdly enought, there was no button to ask eBay to step in.
I am attaching the request details.
I dont understand how the case was closed just like that when i think i properly filed for the return and normally i should be able to return the item and get a refund under eBay Money Back Guarantee.
Anyone had this happen to them ? Your advice on this matter would really help. I am worried that I already lost EUR 100 on scratched sunglasses I wont be able to resell ☹️

When you open an item not as described case, if there's no response from the seller, you need to return to the case in 96 hours and ask eBay to step in. Don't understand why eBay would close a case within 5 days.

The MBG for buyers @soh.maryl doesn't say 96 hours. Please read it again, and show us that 96 hours?
The seller asked eBay to step in @preeybhind which closes your return request. You should expect to either get
1. an immediate refund no return needed
2. a notice that eBay has put the case on hold for additional details from the seller, or
3. an explaination that the seller cannot provide a return label -- leave a private message here to tell eBay that you need that prepaid return label.

Did find evidence that a SELLER cannot close an INR case. Am, however, still looking for that 96 hour or 4 day figure. Keep in mind that my statement was NOT that the buyer has ONLY 96 hours to open a case or to escalate a case.

Sellers can't close ebay cases. They can only respond with information for ebay to make a calculated response with.
Sellers have 3 business days to respond to the request. After that point, either can request ebay to step in. That is a minimum of 72 (3 business days) up to 144 hours (6 calendar days), depending upon where non-business (weekends/holidays) fall.
Then ebay proceeds from that point. When it moves forward from a return request, the request is closed & replaced with a return case.
What was the category the item was listed in? Not every category has return eligibility. You can find that within the original listing. Was this item also coming from some kind of authentication as a Brand?

Would you please provide the Item Number for the purchase? It would be very helpful to read the listing ... especially the shipping method.
I noticed you're in Mauritius. Buyers have different buyer protection when they purchase items shipped by eBay's International Shipping Program OR if they use a freight forwarder ... since the item could be damaged by means outside the seller's control.
