A Chinese scam has turned into an ebay scam. A Chinese seller posing as a US business sold be fake Milwaukee Batteies. I will not buy from China and the business is listed as being in Los Angeles. I received the batteries and immediately knew they were fake and asked for a return. The seller replied and said they were in China and could not supply a return shipping label. They wanted me to open a PayPal account and after I found out how much return shipping would be notify them for the label costs.  There's no way I'm doing that and add to the scam. I notified ebay and they opened a case.  After several chats and being told different things I finally was told to open a Paypal account and work with the seller in China !  This is foolishness. I appealed the decision and by phone was told the case has been decided in my favor and I would receive a full refund. I have not received the full refund and online ebay states my case has been extended to November 7th and to return the items to the seller.  Ebay hasn't got a clue what they are doing and all this is a scam. I'm out $135 and several hours time and the Chinese got their mark.  Ebay does not have buyer protection and their own site says the seller is responsible for the return shipping label. Now I'm responsible because it is a cross border sale. The seller listed as being US and eBay does nothing. There is no buyer protection on eBay, it's a scam too !

I thought when you open a NAD seller pays for return shipping. 

And the seller's items currently listed do say China...not LA.

If the items came from LA then seller should provide a return label to LA as far as I would think.

Just thoughts.

That is not how it works. If a seller lists a US address, they have to provide a return to a US address. I would try another call to eBay support.

My advice is as soon as you receive the item and realize its a fake is to immediately contact ebay on the phone, not through chat.  Explain the situation in detail, be super nice to the ebay rep.

 

I bought some cologne before and what I received was an obvious fake, the box, bottle, cologne inside was all wrong.  I did my homework, I had other genuine boxes and bottles to compare and took photos just in case.  but i didn't need them, the rep said im covered and they were issuing a full refund and no need to send the item back.  Within 30 minutes I received notification the refund was issued.  

 

there is buyer protection and seller protection on ebay.  Depending on the issue ebay will step in and cover the losses, either on the buyers end or the sellers end.

There is no number to call, it puts me in a loop and starts me over time and time again. i got scammed by Chinese and eBay, they have no buyer protection. Each time In contact them I get a dfferent answer. 

 

I'm done with eBay, they're crooks too ! Deleting account today.

The seller's listing address said Los Angeles which turns out to be a Chinses Laundry.

When I bought the batteries I thought they were coming from Los Angeles or I was buying from an American company.

 

They just changed their listing to say they are in China now. It was just changed.

Total SCAM !

You received batteries that were Not As Described.

You did not open a Claim yourself, but depended on half trained phone reps to do it.

Apparently they didn't.


The phone reps have a terrible reputation for getting you off the phone as soon as possible even if that means giving you the advice you want to hear instead of the advice you need to have.

The social media Chat accounts are covered by trained eBay employees with some authority.
And you get a transcript so you can compare what you heard with what you were told.

 

When YOU open a Claim, the seller is told to send you a Return Shipping Label.

There are provisions for cross-border and international returns.

If you don't get the label, you win the case and are refunded.

If you get the label, when tracking shows delivery, you are refunded.

If the seller does not refund voluntarily, YOU go back to the case and ask eBay to escalate.

EBay will refund you and go after the seller for their money.

 

Basically you were reinventing the wheel.

When you Chat with the reps on social media, ask if a Claim was actually ever opened.

If not, you have 30 days from delivery to do so.

If if has, you will be working with the Chat rep to appeal the decision.

 

Note that you are also covered by Paypal if you used that for 180 days from payment, but that PP required the buyer to pay for return shipping. In this case to the seller's US address.

And you can phone the 1-800 number on the back of the credit card you used about a chargeback. Policies between cards differ, but 180 days from payment is the usual Claim period.

The seller has to pay the return shipping.

They can not provide a shipping label, they have to send you the money to cover the return shipping.

That's why the seller wants a Pay Pal email address, so they can send you the money to return it.

Find out how much it's going to cost to return, let the seller know and give them your Pay Pal email.

If a seller wants the item returned to another country other than what was specified on the listing they are allowed to do that as long as they are paying for the label. Since they are not in the US they cannot generate a usps label which is why they are asking for your Paypal address  so that they can send you the money for the label. That part of it is not a scam.   The way it is normally done is that you would figure out the cost of shipping that package to China with Priority International as it has tracking.  First class international does not have tracking.  In most cases, the seller will not be willing to pay shipping back to their country as it will very expensive but you still have to go through the steps.  I think that some sellers assume that you will just give up and not follow through so they return case gets eventually closed.

 

However, someone else can confirm this but I don't think that you can mail lithium batteries to China.  If that's the case, you should contact ebay customer service on FB or Twitter as someone else suggested. If you are not allowed to mail that item back, then ebay should refund you on the seller's behalf.
