Return not as described

I returned an item that was not as described and was charged shipping not to mention tax.  I never should have been charged for either, if item is not sold then there is no tax , item not as described(doesn't  fit ) should get a full refund. If I go back to find copy of shipping label or tracking number I get nothing. None of this is ok with me , if I can't get resolution I will stop using this service. What is even worse is the way Ebay is treating their customers, no one answers a phone , terrible practice. I plan on calling attorney general about how this is working.

Doesn't fit is a remorse return reason, that is why you paid the return shipping. The tax you paid when buying is refunded by eBay with your refund.

 

If the item was not as described,  you should have chosen, Item is Not as Described as the return reason and the seller would have paid the return shipping.

 

So where are you in the process? Have you received your refund?

Never got the tax back , item didn’t fit put that in the complaint. Item listed for John Deere 4100 and the drive shaft was way too long. Contacted seller and he initiated the return process. This if nothing else is illegal, not allowed to collect tax on an unsold item, that at tkeleast is tax fraud. I will submit a complaint to the Attorney General in my state as well if nothing gets resolved.

What’s worse is that there is no way to contact eBay other than messaging which is terrible, they use bots that can’t  or are set up as to not help. No one answers phone, no one gets back to you, terrible customer support, eBay has gotten worse over the years, all they want now is to link to you financial, don’t fully support issues.

I’m sorry but a seller cannot initiate the return process. Sellers don’t receive the sales tax eBay gets that.

If you filed a remorse return for "doesn't fit" then you are responsible for shipping as "doesn't fit" indicates you ordered the wrong size.

 

If you review your refund, you should see that you were refunded a prorated tax amount. You would have received a tax refund on the item cost.

 

But shipping is also taxed in many states so if you did not receive original shipping back then the tax on ship cost would not be refunded, either.

In the text I received it stated that it would charge me for return shipping which was $40 not $83 . So forget about the refund for the item here and focus on the fact that I was charged double the shipping for return. Ok filed a complaint with the attorney general as to eBay’s unfair tax practices. If an item is returned, you can’t charge tax, it is fraud.

Tax is charged when you buy the item, not when you send it back. Good luck with the attorney general.

But with a remorse return @f-n-goofy, the original shipping is not refunded. Therefore you're paying both original and return shipping, and if you paid tax on the original shipping cost that's not refunded.

 

You should have received a refund for the item cost + tax on item cost.

Withheld from your refund would be original shipping + tax on original shipping, plus return shipping.

Why would I have to pay for the shipping, I paid for shipping, he didn’t ship free . So you are trying to say I have to pay double the shipping and tax. That’s ridiculous. Understand that the total was item, shipping and tax . At best I would have to pay return shipping.

When a return is filed for an item as not described, wrong item, missing parts, etc. then the seller has to pay for return shipping and has to refund you in full or refund you without requiring a return.  But if the reason you gave is 'doesn't fit' then that is considered a a buyers remorse reason so the buyer has to pay for return shipping unless the seller has free returns. Sellers also have the option to keep the original shipping amount for buyer remorse returns as they do not get their money back from the carrier

You can't sue Ebay so get that out of your head. Leave the Attorney General alone.  I know exactly the mistake that you made.  You chose ITEM DOES NOT FIT as the reason and it sounds like a remorse return. On remorse returns, the buyer loses the initial shipping.  So you did not get back the shipping fee nor the tax associated with the shipping fee. Some states charge sales tax on the shipping.  Now ,  was the shaft too long because you bought the wrong item or did the seller make a mistake and sent you the part for a different John Deere?  There is a difference. IF the seller made the error, then you needed to open AN ITEM NOT AS DESCRIBED CASE and you would have gotten a full refund.

 

There is nothing that can be done now.  The seller does NOT have your sales tax. 

 

In the future, go slow when ordering parts.  Mistakes can happen easily. Make sure it's the exact part for your item.  If the part does not fit because the seller sent you the wrong item, open an item NOT described case.

I don't know if this helps @f-n-goofy, but I found the listing and looked up that part. The seller's listing appears to be incorrect in saying Part # LVB24900 is compatible with a 4100 (along with many models listed).

 

According to the Deere website, Part # LVB24900 is compatible with:

2025R

3TNV76

2320 <-- that's the one listed on the package sticker in the listing image

2720

3TNV88

 

As others explained above, the problem is you opened a return saying "didn't fit" which is considered remorse.

 

Think about it this way: you buy a pair of jeans that don't fit. Doesn't mean there's anything wrong with the jeans or that the seller made an error, just that the jeans didn't fit to your liking. So you're returning them because you don't like how they fit.

 

On the other hand, if the jeans didn't fit because the seller shipped you the wrong size, that would be considered "not as described" or "wrong item sent" - that indicates seller is at fault for making an error.

 

So the same applies here. Technically the seller sent you the exact part you ordered, but the reason it didn't fit is because the seller advertised the wrong tractor compatibility in their listing. That's seller error. So the reason to select when filing a return is "not as described" instead of "doesn't fit."

 

Seller realizes their error thanks to your return, so they relisted the part without saying which models it's compatible with. Unfortunately the seller took advantage of your error selecting doesn't fit.

 

Since you filed this as a remorse return (doesn't fit), the way the refund was processed is correct for a remorse return with shipping being withheld.

 

You can try contacting eBay CS to see if there's anything they can do to help, but at this point the return is closed and refund is issued so you may not get anywhere with that. But for the $80 in shipping both ways I think it's at least worth asking.

In purchasing a new part, I suggest going to the Deere website and search parts by model 4100 to determine which part number you need. Once you figure that out direct from manufacturer, then you can come back to eBay and search for the right part.

     I understand your comment and I can see why as you described. I guess I looked at it as it didn’t fit with the explanation it wasn’t as described should have been written as was my described and comments tie didn’t fit. 
     I guess you could look at it as I bought a starter for a 3/4 ton Chevrolet and was sent a starter for a 1/2 ton Ford. But yes I can see that it was my error in the way I reported it, thanks. 
     I still don’t see how EBay could make the mistake on the return refund. The have to see it sold with buyer pays shipping of $40 , how can take $80 ? Also when they sent me the return receipt it said they they were charging me the shipping cost of $40 and it would be deducted from my purchase, not $80. The $83.80 also included the tax which cannot be collected as there was no sale so there is no tax. That in its self to me seems to be tax fraud. 
     As to contacting CS , good luck there, I have attempted that and could only get case closed and no one answering the phone. No human to interact with, just a bot message. CS is terrible , so that is very frustrating to say the least
