Hi. I purchased a bust made by the artist/seller. It arrived damaged. The seller has agreed to make me a new replacement bust (which is what I want). He says I can just keep the damaged bust. It will take him 3-4 weeks to make the replacement bust.
Our messages about the replacement are through eBay, but do I need to open a return claim to protect myself?
If the advice is for me to open a claim, how do I make sure that (a) I don’t have to return the bust to keep the claim open; and (2) eBay does not refund me my money while the seller takes 4 weeks to make me a new bust?
I would appreciate advice here. Thanks.

I would file a damage claim and get a refund, and then buy again when he posts the new listing. 3-4 weeks can become 10 weeks and then it's too late to make a claim.

Your Return Request likely will time out before you receive the replacement.
If you paid with a credit card … you will be covered for a few months IF the replacement doesn’t arrive OR is damaged when it does.
