I purchased collectibles for $5,200+ Taxes / from a seller.

Seller kept asking if I was sure I didn’t want insurance. I told him no (insurance is for the seller).

He shipped everything with three separate tracking numbers through UPS. Two of three packages got an origin scan and the third vanished after drop off at a UPS Store.

The two packages arrived very poorly packed in bad quality boxes. One was almost blown out of the side and another was partially destroyed. The collectibles are in art bins inside these big heavy (58lbs each) boxes and the bins were cracked and broken on arrival.

The thing is, these collectibles are worth a fraction of their “complete” value, and seller shuffled them up among boxes everything showed up incomplete.

I do not want to send this all back as it’s a massive headache. Can I just get a refund for the third package that never arrived? Is it a missing item claim or not delivered claim? Could the seller force me to send everything back (a major loss for us both), or can I force a partial refund?

File an INAD and it'll be up to the seller what they want to do.

Go to your purchase history and click return item and select, the item doesn't match the description as the reason.
The seller will have 3 days to accept the return and pay return shipping or refund without returning.
If they don't, return to the case on day 4 and ask Ebay to step in.

So to answer the question, yes, the seller gets to hold your funds hostage and if you don’t give up everything, you get nothing? That sounds like a terrible system to me. I’m not sending everything back. I want a partial refund for what is not here.

If you want a partial you need to work it out with the seller or you can open an item not as described case and send a message saying you don't want to force the seller to pay to send everything back (which the case does) and say you just want a partial for the damage and missing package. The seller will probably play ball

It's up to the seller to agree to play ball. The system is NOT set up for partial refunds. Keep that in mind. Look at the tracking # for the missing item. Maybe by now, there is some activity. Email the seller and explain that you would like a partial fund. It's up to him to decide. What you want as a partial refund may not be what he agrees too. If you open a case, and he issues you return shipping labels, you will NOT get your money back until the all of the items are returned.

It's a Missing Parts or Pieces return request. Out of the 10 reasons on the list, Missing Parts or Pieces is the only reason eBay included on the list to return a missing item for a refund.

eBay doesn't want you to send everything back for the Missing Parts or Pieces reason, just the missing item which didn't arrive in the empty box, to get your refund.

Wrong. The buyer will have to return the entire order, even if citing 'Missing parts or pieces', if the seller issues a label.
When it's back to the seller, a full refund will be issued.
