In Sept. I purchased 2 items approximately $150. The product I received wasn't even close to what was pictured in the auction. I contacted the seller twice with no response. I then asked Ebay to help. I had to wait for the seller to respond before they would help me. He was awful, he threatened me and swore in his replies. He lied and said I called his office numerous times and harrassed his employees. Everytime there was a reply between him and I Ebay lengthened their claim to help me by 3 days. This man actually scared me. I gave up and Ebay did nothing. I have been a member since 1994, I have 100% feedback with 1000's of reviews. I got absolutely no help.
Does anyone read these emails? If they read them I'm sure he would have been kicked off the site with the words he was using. He is a new seller and I see he now has a bad review. That person probably went through the same thing I did.
Does Ebay really have a money back gaurantee? I don't think so.
I was going to close my account, but at this time, I decided to stay on and only purchase from the sellers I have a history with. If Ebay kicks me off so be it. I never thought this would happen to a long time customer.

Did you actually open a claim within eBay as INAD or did you just email the seller and ask for refund? If an actual claim was opened, did you list another return reason other than the item wasn't as described such as something that would be considered buyer's remorse or even checking item not received?

Why did you give up when all you had to do was open an item not as described case? You don't have to communicate with the seller once that is done, unless you decide to. Every buyer who doesn't sell has had 100% feedback since 2008. I've been around a while and would have 100% regardless, but that really doesn't matter since I can't have anything else. I don't understand why eBay would be kicking you off... I don't know all the details of your case but if you paid with Paypal or credit card you still have some time to take the issue of a refund up with them, as long as you truly didn't get the items as described.

I'd stay with eBay if buying here is something that you enjoy. But the next time something like this happens, open a Return request. It's automated... you don't need to contact the seller or contact eBay. Have you ever read the Money Back Guarantee? A lot of good info there for buyers. >> eBay Money Back Guarantee policy

You have 30 days from delivery to open an eBay Claim.
Since that has failed, you are still covered by the chargeback policies of the credit card you actually paid with. Most cards allow 180 days from payment for chargeback Claims. The 1-800 number is on the back of your card.

I suppose as a seller, I should be happy that so many buyers do not know how to open or complete a simple Claim under the MBG.
But geez louize, this is the fourth time today I have typed the same "you messed up your eBay claim but you are still covered by your credit card " message. (Not all responses were here.)

There was no reason to engage the seller. Open a INAD return case, get the prepaid label, send the item back, get your refund. If the seller sends a communication you don't like, ghost them. No need to respond. The return/refund process is automated.

It is quite befuzzling as claims are really hard to botch. I'm not so quick to bring up CC chargebacks, though. 💸

Yes I filed a complaint and also contacted Ebay many times. Everytime I contacted them they increased the date they would help me by 3 days. They would send him a copy of my email and it would escalate his nasty responses. He literally frightened me and he had my address, I had to stop replying.

I filed the correct complaints. I always pay through PayPal. I'll call the bank and ask them what I should do. This guy lives in my state and he has my address. He is crazy and he frightens me. I went back and looked at his feedback and he had 1 negitive comment. Nothing that Ebay would remove, it was warning people not to trust him. Now the feedback is gone. My guess is he went crazy on that guy too and he took it off. I am not afraid to fight I am 66 years old and I thought I've seen everything but this guy takes the cake. You can't imagine what he wrote to me. He has a problem.

I did file a claim. I took pictures of the labels and the product. Is is clear I didn't receive what was pictured. I am not afraid to fight, I did. This guy scared me. His responses to me were the worst thing I've ever read. He lives in my state and he has my address, I wouldn't put anything past him.

You keep saying you didn’t receive what was pictured so I’m thinking you actually opened an item not received case as opposed to an item not described case. Since tracking shows item was received he only had to upload the number and he wins. If you opened a claim as didn’t like or other remorse reason he doesn’t have to accept if he had a no return policy. ONLY if you opened up the case as item not described and then doesn’t match listing or description you would have won. This guy knew the right case wasn’t opened so he knew he could back you down. Slap him with that chargeback and report him for abusive behavior. You also have his address as well so file police report. Abusive behavior is a tough one to prove (at the court level) that report will always be there should you need it. Might not help but definitely can’t hurt either.

That is most certainly not how the ebay MBG works. Did you get yourself opted out?
It is next to impossble for a buyer to not get fully refunded on ebay if you follow the procedure of the MBG.
Methinks your story is not quite accurate or you are not explaining correctly what you did.

Did you open a return claim with the reason "Item does not match pictures or description?" Or did you contact the seller through a message in the order?
And when you contacted ebay for help, was it online CS? Or was it actually through the NAD claim?
That type of claim would have been an easy win for you had you done it correctly, but it sounds like you didn't do it right.

It sounds like between your claim about always paying with PayPal and the 3 day extensions, you filed a claim with PayPal? If so that's the problem, you had an item not as described case with eBay that's near impossible to lose ...,
