Item Not Received w/ Combined Shipping- Best Way to Handle Filing w/ eBay?

I purchased two lots of comics from the UK to the US. The seller combined shipping, but neglected to ship one of the lots. I followed up upon receipt and she is unable to locate the other lot. 

I'm still hopeful the seller will respond, since she was fairly responsive earlier, but I haven't heard from her in 5 days and my 30 day deadline is today.

I can't file a "didn't receive" because tracking shows it was delivered since it was combined with the other lot that I actually did receive.

I can't return it, because there's nothing to return. It wasn't received. 

What's the best way to file this with eBay if the seller doesn't come through by this evening? Right now, I'm out about $54USD, which the vast majority of that went to Global Shipping.

SIDE NOTE- the last time I heard from her, the seller said she wasn't able to send me a refund without getting my email address. Is the UK site that much different than the US one (which is super easy to process a refund- I even sent her screenshots from my acct. to show where it was)? I didn't send her my email (eBay doesn't allow it anyways), but just curious on that aspect too.

She is lying.  She can refund.  Let her know that you will be opening an ITEM NOT AS DESCRIBED CASE IMMEDIATELY.   There is definitely something wrong with your order, it's NOT complete.   You can tell her that and remind her that her that she has to pay for the return shipping.    

To refund, she goes to the order in MY EBAY. She looks for the transaction and she can easily click REFUND.   She would need to edit the amount of the order that you did not receive.   She would also get back a part of the fees that ebay charged her.
