Hello. I just recently sold an item on eBay. And now the buyer is trying to return it for a refund saying the item was damaged and that there was paint on it. The item I sent never had any paint on it and the way a packaged it there was no way it could have got broken like the item in the picture he took is broke. It's a toy. I even made a video of myself packaging the item to show that it was good and intact when I packed it. Because I had a similar thing happen to me before. I think this buyer had a damaged one already and ordered one from that isn't damaged and is now trying to send me his broke item and get his money back. So now I am the one getting screwed. Is there anything I can do about this? Or is eBay just going to side with him? I can not afford this. I am selling things on eBay because I am out of work with children. And this is taking food from my kids mouths.

Your video won't prove anything and they wouldn't even look at it.
If the buyer has filed an INAD and you want it returned before refunding, accept the return and provide return shipping.

There is a money back guarantee on this platform so all a buyer has to do is claim not as described and they will win, every time. That's what a guarantee is. No one will look at your video. This is a he said/she said issue that eBay will not get involved in. Your only option is to accept the return and hope you can sell it again. If you don't accept the return, eBay will refund the buyer and you will not have the item back. It's up to you how best to proceed.

There is no point in fighting this. EBay has publicly stated they will always find for the buyer in this situation. That’s why the mantra has become “never list anything you can’t afford to lose.” It’s up to you to decide what dollar amount you can tolerate.

Yeah. I did that. It's just now he is shipping me back a broke item i know i can't resell. Not the same one I sent him either. I can tell by the pics of the broke one it's different. Just sucks there is no way I can prove it.

Don't get caught up in that. There is no proof the item you sent wasn't broken after you took your photos-- not that I think you did that. Only an actual sale in person, at a B&M store, can guarantee the item isn't broken to begin with. Then again I've even purchased factory sealed items in a store that are missing pieces or have a broken part when I get back home. Stuff like this happens anywhere but it's much more difficult to prove when online. Move on from this and concentrate on remaining positive this was a one off.

its really bad to hear that and I am also got a shocked when hearing that. Please do not send the items if you could bear the risk. this is my just a small advise for you dear.

You have to put a mark on the item somewhere, which can be hard with some things. In my early days I would from time to time list an electronic item and folks would pull the switcheroo, I finally realized if I included the seriel number in the photos it would stop and it did. Another time I sold a lalique wine glass- the buyer had an identical BROKEN one, it came back without my mark, low and behold he had done it many times, so i dont sell anymore. All sellers ARE willing to take these hits from time to time but it is the SAME BUYERS OVER AND OVER- we reported them for years and every one went on ripping off sellers, so there is NO POLICING by ebay- they do not do anything until a buyer steals 100's of items and that is too much for sellers to handle- WE NEED POLICING OF BUYERS, especially because it is so easy for them to get new id's! We told ebay for 10 YEARS to add buyers new ids to our BBL who were already on it but ebay has done nothing but given LIP SERVICE to Wall Street and that is why we all have left. Ebay continually leaves our flies open to be kicked and they keep saying take it for the team, but they are not our team anymore.
