So I bought a Lego set off of eBay, it said the set new, sealed and complete just with no instructions and the box was badly damaged and it was a good price so I bought it. Well I got it and started to assemble the set when I got to bag 8 and one of them was missing and then found out an other bag was missing as well. I didn't notice they where missing because they where both second bags with the number on it there was still bags 1-15 but these secondary bag where missing. So before i go through the refund process can i even get a refund sense the bags are now open and not in new condition anymore even though the seller lied in the post.
Also when I tried so ask eBay it said the item purchased had to be in its original condition so idk if I just got scammed or what.

As long as you are within the 30 day return policy you can open an item not as described and for reason choose missing parts

You can return that no problem. Just select not as described or parts missing.
Seller should have listed it as could be incomplete given the box condition.

Remorse returns where there is nothing wrong with it except you no longer want it are supposed to be returned in the original condition. This is a not as described return so you may return it after you discovered it's missing pieces.
