Falsely Advertised Product

Hi there,

I purchased a Samsung mobile phone from a company that stated it's location as "Located In: Melbourne, Australia" ( in fact they are in Hong Kong) . I believed the phone to be an Australian model and for the first 3 months functioned normally. Then the first android update took place and the phone completely failed - touch screen failed, camera failed etc. I could only get into the phone using a mouse! I took it directly to Samsung who sent it to their maintenance team, they came back telling me it was a U.S. model phone and they can't repair out of region phones. The repairs required for it to operate outside of America consisted of a new screen, new camera and a new battery. So I'm left with either finding a repairer to supply non-standard parts and risk it will work, or obtain a refund. The seller is refusing to refund as it's outside of the 90 day warranty period, and there seems to be no path to pursue this through Ebay. I have offered to work out a deal with the seller (I'd even accept a 50% refund) but the seller is point blank refusing anything to do with it.
Have I simply done my money? This was a falsely advertised product, I still have the ad and nowhere does it state it's a U.S. model, nor that it was being shipped from outside of Australia. 

Any advice would be appreciated!
