I couldn't find how to delete post.
The short of it is the item is more than a month late, I asked seller if he would accept a inr refund. I saw eBay had a new policy that seller gets compensated and thought to ask them.
I was going to file regardless since I got a replacement item due to late time and was probably going to file regardless, but I don't really know if I overstepped by messaging seller about it and explaining the process.

Well... "overstep" is a harsh word. You gave the seller a heads up... no biggie. The seller won't be compensated if you win the claim... and you'll be made whole. (If the seller has a 'Delivered' scan, the seller will win.) Now, if you find that you've been caught in a fake tracking scam, come back for more advice. But we'll help you cross that bridge if you come to it.
Since the system is entirely automated, go ahead and open your INR claim if... it's (at least) one day past the Estimated Delivery Date on the order. Remember that you only have 30 days from that time to open a claim. Good luck.

Not sure, but you may not have prepared yourself for buying and selling on eBay if you've not yet got acquainted with the eBay Money Back Guarantee for buyers. Have you read it?
