30 days and still waiting for ebay to decide on return request

I bought and item on ebay and when I received it, it was completely different than what I had ordered.  In fact the name and phone number on the shipping label wasn't even mine (and yes my name and phone is correct on the ebay shipping address).  So I contact the seller, no response so I opened a return case, seller responds that he/she doesn't accept returns.  So I escalate the case to ebay.  ebay put case on hold to allow 5 days for seller to send return label.  5 days pass and no return label so then ebay put case on "Hang on, we're still reviewing the case".  I call ebay they tell me bacause item is over $1,000 a specialist needs to review the case but I should be hear back within 24-48 hours.  It has now been 1 month and I have not hear back ebay (case is still on "Hang On, we're still reviewing".  I called, chatted, and even message via facebook with no success. Everytime ebay tell me case is decided in your favor but needs to be reviewing by specialist.  After dozen phone calls and refusing to accept their answers of 24-48 hours someone will get back to me I did manage to find out that someone at ebay screwed up (never sent email to seller to send return label) so when specialist reviewed the case it was denied 3 times.  Finally after 3 weeks someone did send an email to seller to send return label but seller never did and case is still on hold.  This is crazy, ebay is publicly traded company (not a startup) and this is how they conduct their busienss!  On top of that when I call ebay they are not able to talk to specialist (specialist work offline and no way to contact them).  I have had ebay hang up on me several time because it was too much work for them to investigate this case. I have had ebay tell me someone would call me back, no one ever did.  This is just crazy!  I did contact paypal but they said that I have to work through ebay. I did call my credit card company but they said I need to work with paypal to return the item and only then can they open a dispute.  FYI I have been buying and selling on ebay for 8 years so I am not new to ebay and NO I didn't try to return the item just because I didn't like it.  I try to return the item because what seller sent me was not what I ordered.   My advise don't buy anything over $1,000 otherwise you will face this nightmare and don't use paypal because paypal just directs you to ebay. You better of using your credit card on ebay so that it will show up as an ebay transaction on your credit card and not a paypal transaction.  The frustrating part is no one at ebay can get this resolved.  They all say the same thing "we are sorry and rest assured we will do everything to get you a refund" but yet they can't contact the specialist, can't send an email to the specialist.  All they can do is add notes to my case and hope the specialist will see it when ever specialist get to my case.  And they cannot give me an ETA on when specialist will review my case.  Could be days, weeks, months, yeas! no one at ebay knows!

The usual routine in this situation is: buyer opens item not as described case.

Buyer then waits 96 hours , returns to that case and asks eBay to step in.

eBay does so and buyer is refunded.

So I do not understand what's going on with this.

I have called ebay through their website (call back).  I have chatted with ebay through their website.  I have contact ebay via facebook message as well.  ebay has responded in all three cases but same deal... specialist is reviewing nothing they can do.

The issue here is 2 things.  1. anything over $1,00 has to be reviewed by a specialist (some ebay CS I spoke to called it back office, and other call it a secret team).  ebay doesn't mention this on their website but if you call ebay they will tell you anything above $1k has to be reviewing by specialist and they specialist is the one who approves or denies the case, they can even override what the the front line ebay people decide (the ones we talk to).  This happened in my case because when I asked ebay to step in, they are supposed to send the seller a final notice to send return shipping label which they forget to do.  And so when I called and front line people put a request to close case in my favor specialist denied it 3 times because email to seller was never sent.  This was only discovered 3 weeks after I escalated the case to ebay and it was only discovered after I called several times a day bugging them asking what is going on.  The problem is front line CS don't have access to specialist team so all then can do is update notes in the case.

How well have you been vetting the sellers from whom you purchase? Yikes! I've rarely seen so many "scammer" accusations!

I don't think ebay is trying to be nefarious.  I think the problem is the front line C.S. (ones you talk to) don't have access to the specialist.   All they can do is update the case notes and hope specialist will do their job.  Also there is no ETA or SLA by which specialist has to review and decide on the case.  They can take however long they want to.  ebay now charges ~17% on each sold item (if your not a small business and just selling things like I do as individual) and ebay now process all transactions (no more paypal).  The reason ebay gets away with all of this is because there is no viable alternative to ebay.  I miss the good old days of ebay back 20 years ago as a seller.  In this case I am the buyer and still ebay is screwing around.

This is not a question of vetting the seller.  This is a question of ebay process and being transparent.  If there was not buyer protection half the people won't buy on ebay.  ebay is marketing itself has an amazon alternative and I know I wouldn't have this issue with amazon.  The problem in my case is 1. ebay is not transparent with their process (no where on ebay buyer protection doesn't it mention anything over $1,00 need to be approved by a specialist  department; also they need more status:  "Hang on, we're still reviewing" status for 30 days means nothing. 2. front line C.S. don't have access to specialist team.  3. as a result of front line C.S. not have accessing to specialist team, my case was denied 3 times because front line C.S. didn't send seller a request to send return label.  So in the end this isn't about vetting the seller, its about ebay's return process.  As I said before if ebay has not buyer protection, no one would buy on ebay.
