I need help.
I bought an item on eBay and it was damaged when it got here. I am covered by the money back guarantee and am not obligated to send a return to the seller because the original listing states no returns.
will I be reinstated for my money without the need of returning the item because of the listing?

No, you will be expected to return the item if the seller wants it back and they send you a return shipping label.

We’ll see the sale says no returns. And eBay covers it in the guarantee.

...Um... that is not exactly how the MBG works.
You need to open an item not as described case against the seller (INAD.) The seller will have 3 days to respond to the matter. The seller can do any of the following:

Could you imagine what kind of crazy theft would go on if "no returns = do not have to return + keep my $$$ and their item FOR FREE!
There are buyers who would just claim the item was damaged so that they can keep the item AND get their money back too...it already happens here all too often...just read these boards and you will see for yourself.

Well yea I understand that it doesn’t work that way but I don’t trust the seller any longer after they tried to have a heated argument with me

Since you did just state that you do not require to return the item i can see why seller would have a ''heated argument'' with you. Seller may not be convinced that there is a problem and may suspect you of fishing for partial/full refund.
If there is a problem just open return with detailed information about the problem, possibly some pictures and seller will respond by accepting return, offering partial refund or will just issue full refund.
It all depends on your situation.

The seller's no return policy is void for damaged or not as described claims.
Simply file a claim. The seller will be required to accept the return no matter what their policy is.

There is no need to deal or communicate with the seller anymore. You don't need their permission to return.
File a claim and the seller is required to send you a return label, then return the item and you are refunded when the seller gets it back. If the seller ignores or refuses a return based on the not as described claim, then you will still get a refund and ebay may let you keep the item also.

What everyone is saying is correct no point arguing eBay will protect you as the buyer. If the Seller does not want to work with you as you say simply open a item not as described case on the item. The seller will be required to provide a return shipping label you will then have approx 2 weeks to return the item with the label they provided and once the item arrives back the seller will have to refund you or eBay will do it for them. There is no option for the seller to not refund you as long as you use that label and it tracks delivered back to the seller. If the seller doesn't provide a label or respond to the case you can escalate it and eBay will force it. No returns means absolutely nothing on this platform.
