This looks like something I am offering.
If eBay wants to offer this it should be on the checkout.
Either way it should clearly state that this an insurance is offered by eBay – not the seller.
This is a NIB item – a Daisy BB Gun – what is being insured?
I have a 30 day return policy – what would anyone need insurance for?
Once again my real issue is that this insurance is not labeled eBay and looks like something that I am offering. That makes my item look suspicious.
I have been selling for years and have never had this happen before.

You're offering a new item. Apparently eBay recognizes that and displays the insurance option.
Aside from changing the condition to "Used", I don't know of anything you can do about it.
Besides, you'll shoot your eye out (sorry, couldn't resist).

I agree the checkbox for purchasing Assurant scam warranties should not be on the listing and plainly disclosed that they are from ebay and that ebay will not offer ANY Buyer protection. Check Assurants Feedback, thousands of negative feedbacks.
