I have not got the purchased item. The delivery date was several days ago. The seller repeats his answers like a robot and not willing to refund. I opened a claim and ebay status for several days is:

How long should I wait for refund?

If you opened an ITEM NOT RECEIVED CASE and nothing has happened for at least 96 hours after you opened it, you need to return to the case and ask eBay to step in.
If, however, there is tracking indicating that the package is moving through the system, eBay may ask you to wait a few days to see if it does arrive.
You've not mentioned exactly what you've done so far and when you started your case.

After you open the claim the seller has 3 days to respond. Sometimes eBay allows the seller more time if tracking shows it's moving and not stuck.
Just be patient. You'll get the item or a refund. If you don't then you will be able to ask eBay for help.

It seems you might not have read the eBay Money Back Guarantee, because that middle part, that's not what the MBG says.

The seller is in China and with 94% feedback, I'm not optimistic that he'll issue a refund until you escalate the case.
You don't say how many "several days" is that the case has been pending.
With 7 INR allegations just in the last month, I doubt the seller will be around much longer.
I expect you'll win this case as long as you don't let him keep you hanging long enough to lose your MBG protection.
