Seller not honoring return when documentation says he would

I placed an order for my Mom on Friday & she passed away on Saturday so went to cancel the order as it hasn't been shipped & seller was hard to get a hold of & he finally said he would take the shipment back for credit as it was shipped after I made the return request so I contacted UPS & they told me how to refuse the shipment to return to seller as he would not refund me the shipping charges & I had to pay for the return when it was his fault he didn't stop it. I refuse to pay $32 plus in shipping charges for a $24 item. The seller then said he would take the return back minus the shipping charge which I said was unacceptable. He then messaged me that he would not accept the return (I have the messages stating both) So I contacted my bank & stopped payment & filed a dispute over this order. I have not yet received the order yet. I also started a return then today the seller messaged me that he closed the return & wouldn't take the order back. What are my options on this as I am not keeping the product as delivery is going to be refused & what are my options for help with ebay as I can't seem to get anywhere ??

Since you opened a case with your bank, Ebay is out of the picture now. And refusing the delivery causes you to lose all buyer protection on Ebay anyway.Sorry about your Mom.

I'm very sorry for your loss and I'm sure that some of your missteps are a result of the stress you feel. 

 

But you were premature in leaving feedback and blaming the seller. The seller really didn't do anything wrong! (The seller's response reflects so well on him!)

 

Since the seller was unable to cancel, what you should have done was to wait to receive it and requested a return. It certainly sounds like the seller would have accepted the return even though his "no return" policy would have allowed him to decline the remorse request. 

 

But at this point, after going to your bank, you'll be unable to open any type of request through ebay.

Let me sort this. The seller said he would refund your remorse return but you didn't  want to pay return shipping because you thought it was his fault because he didn't  stop it from being shipped.  Is that right so far?  You figured you would refuse delivery which would save you from paying return shipping.  Then you got upset because the seller wanted to deduct the original shipping so to avoid that you ran to your credit card company and disputed the payment in order to get all your money back.  

How am I doing so far?

 

ADVICE: eBay policy says the seller is allowed to deduct the original shipping you paid. You are the one wanting to return it for buyer's remorse- it's remorse if you no longer need it. I'm sorry for the reason you no longer needed it but that's not the seller's  fault. In fact you lose eBay MBG when you refused delivery. 

Sounds like the seller was doing exactly what they were supposed to do but you didn't want to lose shipping money so you filed a chargeback.

At the very least this this caused the seller to spend money to ship it to you that they never get back.  

 

It is supposed to work like this------you accept delivery. You open a return case citing you no longer want it and eBay charges you for the return label. When it's  received back the seller deducts the original shipping from the return.

You buy a item and try to have the order canceled, which the seller is not required to do.

Instead of paying to have it returned, you're just going to dispute the charge, which you made?

Thank you about my Mom & if she didn't pass I wouldn't be on here to try & resolve it. He left me no choice but to get my bank involved & at this point buyer protection was a joke ! I will take my chances with my bank & not worried about any problems with ebay as they were not any help whatsoever.

I'm going be honest and tell you why what you are doing is dishonest. A chargeback is to dispute a charge you think is incorrect.  The bank will automatically find in your favor because you are their customer and if you lose  you'll get  mad and close your account.

The charge was not incorrect. 

You agreed to abide by the rules here when you joined. Sorry but wanting the money back because your mother passed away is not the seller's fault and they shouldn't be punished for it. 

 

You should have accepted the item and resold it or filed a return  request after you received it if you no longer needed it and been responsible for return shipping. That is how it is supposed to work but instead you are disputing a charge that was correct and that act will cost the seller a $20 chargeback fee because you're a name I'm not allowed to say.

 

Every seller that reads this will block you as they should.

Yes you have it right. I did open a return up & he agreed to the return as it was for my Mom who passed away last weekend & had no need for order. So he was a jerk about everything & I contacted my bank & they agreed with me so how can someone charge you for something agree to take it back then closed the return so he left me with no choice & stopped payment & spoke to my friend a lawyer & I did the correct thing & really don't care hoe ebay handles it as I tried every single type of way to contact then with no success & I even got the sellers contact info & tried it that way again no success so I did what I had to

Yes as pkg was refused & he won't honor the return of which he said he would in a message so I did stop payment & bank already put the funds back in my account. I don't care what ebay says or does as legally I did the correct thing & even got advice from my lawyer so not worried at all as I'm not getting screwed out of my $

I did & bank already refunded my $. Seller didn't honor return of which I have in writing from him so left me no choice

Did you tell your bank, the seller was going to accept the return, but you didn't want to pay the return shipping to return it?
