Purchased fake Kenzo , should I return as counterfeit?

Hi all, 

I just got a tiger Kenzo sweatshirt with two spelling mistakes at the back of the care tag. It says "name of compagny" instead of company and under that "adress" instead of "address".

The inside of the tiger logo is also wrong, its not embroidered at all. This is clearly a fake.

Can I return it?

Absolutely.  You suspect it's not authentic is the not as described reason. Take pics of the label.

Open a return request and choose "does not seem authentic" as the reason.

Seller agreed to refund so I send the item back yesterday, currently waiting for a refund.

Did you grt a tracking number for the package  so you can prove return shirt reaches the seller?

I got the certificate of posting and receipt.

I send it with first class so there is no tracking as its next day delivery.

I send the seller message now if they received it yet. I do have a reference number for the item. It says update will be provided when they attempt to deliver the item. So this means they haven't delivered it yet right? 

Seller is going on holiday on Monday. 

What should I do now?

As long as you have proof   that the shirt was returned  to the seller  if the seller tries to claim they did not get it you should be fine. 

Have you opened a  claim with eBay for this item yet?

Not yet as she said she has no problem returning it, she has a 14 day return policy.

I have a reference number for confirmation or delivery as 1st class is not tracked. So I will receive an update when it's delivered only. 

She hasn't replied to my email yet. Should I open a claim still?

If the shirt was indeed fake, she should have provided you with the return shipping label. That would have included tracking. Did you have to pay the return shipping cost? 

I hope this works out for you and I hope the seller is honest.

Yes, I paid the return cost.

Reference number shows it hasn't been delivered, so it will be on Monday. The seller also said she doesn't have it yet.

Can I open a claim later or do I have to do it now?

You've done it in the wrong order. You should have opened the SNAD dispute before sending it back but having done that, open SNAD after delivery takes place. 

Once you see on USPS that the tracking number shows as delivered, open the dispute, state that the item isn't authentic and was already returned to the seller, tracking # (fill in the blank), delivered on (date/time) and you want the refund. 

Seller will be given a date by which to respond and if you don't get the refund by that date, escalate to ebay and they should issue the refund and close the case.

I just hope that whatever type of tracking you used shows delivery online.

I will receive a update when it's delivered, so the reference number will show its been delivered to the seller.

The seller said she is going on holiday today.

I just got this refund, but without the postage I paid first time around so kinda disappointed since I paid for return too.
