Item listed in wrong category. item unavailable.

I bought a buy it now Nikon D80 camera. Under Order Details it stated the camera was seller refurbished, that there was one available and three had been sold. There was a picture of the camera. A 60 day warranty was also published. In the initial EBay listing across the picture of the item it said "Camera Repair." Under Order Details that caption was missing on the picture.  I assumed the seller both repaired and sold cameras. After the purchase the seller sent me a message asking if I realized that he only repairs cameras and does not sell them. Of course my $150 had already been debited from my credit card.  When I attempted to cancel the order Ebay informed me that it was too late and to contact the seller. The delivery date for the non existant item is schedualed for this Thursday.  I may not have a problem. The seller did take the initiative to contact me in good faith. Any confusion could well be unintentional on the sellar's part. The only problem I do have is that I believe a listing for services should not be on a for sale sight with a picture of the item that the buyer would naturally assume is for sale. Is the omission of any statement that the "seller" only repairs cameras an attempt to avoid Ebay's policy for catagorizing an Item in order to place an ad for repair services on a sales site? Is that even against Ebay policy? Aso, there is no "Customer Service" help or contact that I could find for the r purchase of an nonexistant item.
