Ebay item condition category

     An Ebay seller has an electronic item for sale and lists the item as Used.  The Seller Notes Read: Used but in great conditon turned on but not tested.

     Ebay policy states in part: USED - "An item that has been used previously. The item may have some signs of cosmetic wear, but is fully operational and functions as intended."

     My question is this.  Is an Ebay seller allowed to list the item as Used and then in the description state the item has not been tested?

      The description is a contradiction of the listing as Used.  

      Is this practice being condoned by Ebay?  Will Ebay uphold Their Policy on USED?

Yes, eBay will uphold a defective item case if the item doesn't work, the seller will even have to pay to have it returned to them.

I see a lot of estate buyers who have no idea what they have or how to use it. I tell people who can't be bothered to test items to list as non-working parts.
