purchased an item off ebay. seller gave incorrect tracking number. and made an error in sale.

seller also said they weren,t able to complete the sale because of an error on their part and I would get a full refund. Fine, except no refund forthcoming. When I again contacted the seller I was told "all staff on leave until Oct 9th". Still no refund and now cant contact seller.  I paid for the item with my c/c in good faith. looks like I have been scammed and I want a refund.

How long ago did you purchase it?   You can file a item not received case with ebay.

Well, if you made a purchase from a seller off eBay, then eBay is not a party to your problem.

 

You've been scammed, and eBay can not assist you.

There's no difference. I bought speakers off a guy at the club.

 

OP shared enough details that it's a purchase from an eBay seller, over 60 days ago.

I understood it in the form of "from" ebay when they said off ebay. 

 

They are in Australia.

I still don't get past them saying "I'm going to the hospital to die" when they mean today.

Regardless of accents ,  innuendoes,   or otherwise, OP: 

 

I would attempt a chargeback to your credit card. At this late date , neither  the MBG nor any other eBay- provided assistance will any longer be in effect.

Sorry, but to those who care about proper grammar there is a difference. And you did not buy the clubs "off" a guy at the club, you brought them "from" a guy at the club. Yes, yes I know - picky picky. But that is the type of linguistic inaccuracy that drove my grammar teacher to distraction. To say nothing of that ruler.

 

The question was did the OP execute the purchase through eBay (i.e. on eBay) or did they make the purchase outside of eBay. (i.e. off eBay). It DOES make a difference.

 

The fact that the OP was able to contact the seller after the fact has no bearing on whether the OP bought them through eBay or outside of eBay. It still makes a difference.

Just to clarify, the item I "purchased" was listed for sale from a seller on ebay.

I take your point, however, albeit picky.
