I saw a bench made knife and bid on it ,,,i noticed it was listed as a clone, the bid then was out bid and I was like thank goodness, later the person who was winning somehow canceled their bid and it was drop on me , The rules say if a item is counterfeit or trade mark infringement that its not allowed, this knife says Benchmade and even has a bench made box ,ebay allows this listing and continues to allow ,trademark infringement items especially  in knifes

i was the one penalized for not paying for this clone knife, i explained i saw a bechmade and bid on the knife it was a fake and listed as a fake ,i counld cancel the bid either as i dint know i won the item when i left the page i wasnt wining the bid ,I wish Ebay would not allow counterfiet items like their policy states . I have perfect feedback and I both buy and sell on ebay this whole ordeal caused me more anxiety then i need, thanks for listening gary

They don't, but the item needs to be reported so they can check and remove it, if it's counterfeit.

Considering the number of items listed daily from around the world, eBay cannot possibly vet all of those listings. They do have a VErified Rights Owner's VeRO  program, companies can join that can get fake or counterfeit listings removed.  Otherwise, it is up to buyers to do some checking before bidding on or buying items.

 

How much research did you do before bidding on the knife?  Did you look at the seller's feedback profile to see where the seller is registered, and click on the numbers of neutrals or negatives the seller received to read only those comments?

 

Did you read everything in the listing including the item specifics, which in the Brand Name box, might have either been blank or said Unknown?   The details you have given us about the transaction, sound like the listing was posted by a seller from a certain Asian country well known for counterfeiting things, and using unfair auction tactics.

 

If the listing showed a photo of the knife with a Mfr's. box, but in the specifics did not identify the brand name. You can try contacting ebay's customer service to get the unpaid item strike removed because there was misrepresentation of the Brand Name, and that's why you did not pay.  You can also report the item from the listing page.  However, since you sell in that category yourself, your report will not carry much weight, unless the seller has feedback for selling counterfeit items.

If you win the item and it proves to be counterfeit when it arrives, you can file a return using that as the reason for the NAD return.  I don't believe that you can take action on the infringement as that would be up to the trademark owner.

 

You probably should have reported the listing rather than bid on the item since you seem to have been aware of the issue.  Assuming, of course, that you read the listing completely prior to bidding.
