Siller Lists 9 WEEKS for delivery!!! How can I get this canceled?

I recently purchased an item and the seller (in China) still hasn't mailed the item after 2 weeks (bother other items from the same country purchased the same day have already made it to the US).  I tried to file a claim, but the seller listed April 2nd as the outside delivery date, so I can't seem to do anything.  This is LAME.  A seller shouldn't be able to list whatever date they want for delivery.  

 

The fact that I purchased this on 01/24, and it still hasn't been mailed should be more than enough for Ebay to force a cancelation.  Is there any recourse??

eBay provides estimated delivery dates based on shipping service and handling time. The seller is not providing those dates. The estimated delivery window is shown on the listing and on the checkout page before you pay. If the window, which is just an estimate not a guarantee, is too long then don't buy from that seller. Always look at the latest date in the estimate, not the earliest. eBay is too generous (short) with most of their estimates.

 

Buyers can request a cancellation, but sellers are able to deny them.

 

Sellers are not required to ship with tracking so you don't know if the item has been shipped yet; a lot of sellers from China ship without tracking. So no, eBay is not going to force the cancellation just because there's no tracking because eBay does not require the use of tracking.

 

If nothing arrives by the latest date on the estimated delivery window, starting the day after you'll have 30 days to file a non-receipt claim.

 

In future, don't buy from China since you'll face these long shipping windows and possibly additional tariffs.

That is NONESENSE.  Most items from China arrive quicker than items from Canada (and I've had far fewer problems with Chinese sellers than US ones).  Enabling lazy handling proceedures FALLS SQUARELY ON EBAY, and enables bad actors - thereby promoting diservice to customers.

P.S. You are WRONG.  The Seller DOES list BOTH handling times & shipping methods (have you never sold anything here before?).

Listing "Whenever I get around to it" for a handling time and "Strapping to the back of a goat headed West" as a shipping method are clearly NOT up to normal standards for any sellers - much less the largest producer of consumer items on the planet.

All it's going to do is make me go to AliExpress instead of Ebay.  Dumbing down standards to somehow 'MAGA' everyone into buying domestically won't work.  Just 10 years ago, Chinese sellers were held to very tight standards (every complaint counted as a strike) and while that was arguably a bit too strict, removing all standards to encourage bad sellers in China to somehow make buying from there look bad, just makes Ebay look bad - as it is completely their fault.  People will usually rise to whatever standard you set for them.

Please explain how it's ebay's fault that a Chinese seller doesn't ship their items in a timely (in your opinion) fashion.

 

As you claim, "most items from China arrive quicker than items from Canada" so wouldn't this be on the seller and not on ebay? And wouldn't it be on you for choosing a seller with a very long handling time?

Good grief! If that's what the seller's listing said for handling and shipping method, you are 100% responsible for having chosen that seller and 100% responsible for your own mistake in not hitting the back button and finding another seller.

Uh yeah, that's exactly what I said. Seller provides handling time and shipping method, and using that data eBay makes up their own estimated delivery dates. To show you how wrong it can be, let's spot check a handful of my sales from today:

 

1 biz day handling means I ship orders from Fri Feb 7 on Mon Feb 10

Shipping service offered is Ground Advantage

 

Items spot-checked are shipping anywhere from halfway across, to all the way across country

Typically transit time for Ground Adv will take 3-6 days if no delays, and right now anything passing through certain facilities in the midwest are getting stuck for days and weeks at a time.

 

So, ship Mon Feb 10 and eBay tells that buyer across the country that they should expect their item Feb 11-13.

 

In what bleeping universe?

 

This demonstrates my point: sellers aren't providing those estimated delivery dates (EDD). eBay is determining those dates. Sellers can't control what EDD is shown to the buyer.

 

When the seller is in China and offers economy shipping, sure you may get the item quick within a few weeks, or it can take 8-12 weeks. While it's not a habit of mine to buy from China as I don't want to wait 2 months for a low quality product, I have purchased a few inexpensive things from China and experienced the long end of that estimated window, and other items received within 3-4 weeks. eBay's accounting for the longest end of the window because so frequently those economy items ship from China without tracking.

 

eBay does have stricter standards for international sellers listing on the .com site - they are rated on so many criteria US sellers are not under a "bad buyer experience" policy. Even feedback affects their performance rating.

 

But all that is beside the point because what matters is you were shown the 9 week EDD before you committed to the purchase. You agreed to that date when you gave your payment info and confirmed the purchase. You now have remorse because you hoped it would get there sooner even though nobody - eBay nor seller - made that promise.

 

As I said - don't buy from sellers with long estimated delivery dates if you are not willing to wait for your package. Doesn't matter where seller is located, same advice applies. I mentioned China before because it's clear you prefer those inexpensive items from overseas and that's where you'll frequently find the longest delivery estimates.

  eBay is not a party to the contract, so they have no way of forcing cancellation. They allow you to ask the seller if they will agree to cancel your contract with them, but cannot force them to agree to that.

 

  When you purchased the item you entered into a contract with the Seller, for them to deliver the item within their stated Handling -  Shipping - Estimated Delivery time frame.  The estimated time frames are shown on all listings.

There is a See details button to the right of Shipping: Cost - Service, that when clicked on shows a seller's handling time and other shipping information.

Under that is ebay's Delivery: Estimated Delivery time frame.

If you want to spend your money in support of the Chicom Government, you have that right. However, even they sometimes have in stock issues in their U.S. warehouses and cannot deliver on time. There can be delays, especially at this time of year (Chinese Lunar New Year) which is a 2 week national holiday.

Seems to me you actually read the listing after the purchase, and in fact well after, as in once you started wondering where your item might be... It is then you discovered the seller's outrageous handling and delivery times, however... And I've been in your shoes, I know how you feel but... If the seller posted those handling and delivery times upfront (which it appears they did) and you had access to this information before you made the purchase?

Well, the nice folks here are saying that's on you.
Unfortunately I dare say they are correct.

Both seller and buyer have a responsibility to meet, the seller must do their part but everything else falls on the buyer. So if the seller has in fact claimed they will mail their item on the back of a goat (which by the way, ebay doesn't allow that) but assuming that the seller claimed this and you were given the opportunity to review this information prior to making the decision to purchase... Then it is in fact your fault for not taking advantage of that information to make an informed decision.

As for AliExpress, good luck there, you think Ebay protects their sellers too much?
