I purchased an item from Japan on 12/28 and I'm in the US. The item has until the 17th to get here. I emailed the seller on the 3rd just simply asking when they think the item might ship so I have an idea when to expect it. I haven't heard back from them. When I purchased the item I noticed that they had sold over 200 items and have a 97.8% rating. I also looked at the sellers store and they had a lot of different items. I checked the store yesterday and I see everything is now gone. I'm nervous that this person has flaked out on me. My question is should I be nervous and ask for a refund or should I just wait until the 17th and then ask for a refund. I have sent the seller a couple more messages but I haven't received a response at all.

Two things.
eBay doesn’t require anyone to communicate.
eBay doesn’t require sellers to ship with tracking.
If your item doesn’t arrive by the last estimated date of delivery you can open an item not received case through Money Back Guarantee.

There is absolutely no action you can take until your item is overdue. If the EDD is the 17th, then you can open a case on the 18th.
On the other hand, that 97.8% is not encouraging. A general rule is to expect a seller to have at least normal temp-- 98.6. What does this seller's FB look like?

If they've only ever sold around 200 items in total, that's not necessarily a cause for concern-- all it takes is one negative to really cause someone's percentage to drop if they have a low number of recent feedback.
