Hi, I purchased an item from a seller on Apr 20, and it arrived fully damaged from Fedex. I contacted the seller right away, and they confirmed on May 4 that Fedex will offer a full refund and they will refund me both the amount and the shipping (total over $700). I figured it would take time for fedex to offer the refund, so I thanked them but did not follow up right away. I've since tried following up a few times for 3 weeks so it is clear they are not going to honor this and are avoiding me. This seller is still active and selling many things on eBay. Unfortunately I didn't realize I only had 60 days to appeal to eBay or to even give Feedback on the seller. EBay won't even let me speak to an agent.
Is there anything I can do? At minimum I feel I should warn other eBay buyers that this seller is a crook.

Within eBay there's not much you can do.
And feedback...if you had use the work 'crook' in feedback...usually a seller or eBay will remove the feedback.

You said you tried following up with the seller for 3 weeks, but then say you have gone past the 60 day limit for ebay appeal. Did you ever make a formal SNAD complaint to ebay?
If the seller has run out the clock on ebay's protections, your remaining options are to go to PayPal (if you used them) or your credit card (I hope you used them!) in that order. Other people will hopefully be along soon with specifics on how to handle a damaged item return that was not refunded.

Sorry, but you should have filed an INAD through Ebay for a refund and let the seller deal with FedEx.
Contact your payment source and see if there is anything they can do.

I believe your time frame with eBay is 30 days starting with the date it was delivered to file an "item not as described case" and follow up after you submit it.
PayPal, if you paid that way, used to allow more time but they have also gone to the 30 day time limitation.
Hopefully, you paid with a credit card, and they allow more time to contest the transaction.

Thanks everyone. Lesson learned, I should have filed with eBay even while the seller was making their claim. I can't find a way to file an "item not as described case" - thankfully my credit card is letting me dispute it.
