Seller Negative Feedback

Folks - I'm looking for a sanity check here. 

 

Back story - bought a electric train set from the seller.  It arrived broken.  The seller also described it as brand new.  You could tell from the packaging that components were used, original wrapping was not present, indentations in the styrofoam packaging from cords and components not being in the proper place, dirt on the track and other components, etc.  He also shipped it in the store display packaging which may have contributed to it being broken.  I submitted a return request.  I provided pictures of the broken components, a description of why it is not brand new as described, and the ebay buyer protection rules.  He accused me of replacing the set with a broken one on multiple occasions.  Finally, on the day before I would be able to ask ebay for help, he sends me a shipping label and accepts the return.  Some how, I only received a partial refund.  It looks like he somehow was able to deduct the return shipping from the refund.  After 7 calls to ebay customer service over the span of weeks, all promising me that I would receive the remaining portion, I gave up on ebay actually helping me.  I used my credit card company to obtain the remaining portion the refund.  

I remained professional throughout the messaging process and left out my emotions.  Facts only.  I left negative feedback.  "Dishonest.  Item not as described.  Broken.  Tried to avoid refund."  I do consider this seller to be dishonest.  The item was clearly not brand new as described.  He fought me throughout the return process, let alone the hassle with not getting a complete refund through ebay.  I suspect he bought this thing at a flea market or salvation army store and tried to dump it on some unsuspecting buyer without testing it first.  Frankly, in my mind he's lucky ebay limits feedback to 80 characters.

 

He's now messaging me requesting the negative feedback be removed/changed.  He says I got my refund, i should be happy.  In the same request, he's still accusing me of replacing his item with a broken one.  I can assure you I do not keep a stash of these things laying around.  He's also sent me 5 messages telling me he's "going to call ebay on you!"  I've archived all his messages from the beginning.  To me, they do not present the picture of a professional seller.   

 

The bizarre thing to me is that he has no other negative feedback.  Most of his other sales are of electronics and never trains.  Did he sell something he knows nothing about and got caught?

 

Am I crazy to not want to change the negative feedback and ignore him?  I'm sure that I'm spending more mental capital on this than I probably should.  

 

The whole incident has turned me off to ebay.  I will never buy anything of value on here again.

Just leave the fb,delete unread all messages and move on.Do not let 1 bad transaction sour you.

...if you file INAD (item not as described) case you should get your entire money back that included shipping cost, the seller does not have any right to subtract any money from you...

 

...did you escalate your case with eBay, and how long since this story happened...?

 

...btw, were you able to recover your partial financed loss from your bank or from eBay...?

 

...don't respond to the seller anymore as such a this activity will create traumatic sentimental...it's up to you but if I were you, I would leave thing alone as it was in original situation and...move on...

 

...not because of killing one rat, you have to burn the whole house...so don't give up on eBay, there are still potential of honest sellers here, whom play well with eBay rules and appreciate buyer's businesses...

On the INAD... it was very strange the way the whole thing happened.  I submitted the request for return within an hour of the packaging arriving.  Went back and forth over the messenger with the guy for 3 days or so.   Like I said, he accepted the return at the last minute.  He then asked ebay to review.  I received notification that ebay decided in my favor.  Then I only received say, 75% of the refund.  I started escalating this 2 days after the decision was in my favor, when i received the partial refund.  Every time I used the ebay call me feature, each customer service rep said "yes, you are due a full refund.  I am escalating this in our system and you should receive your remaining refund."  It became laughable because each succeed rep would give me a longer time window, 2 days, 2-4 days, 3-5 days, 5-7 days, 7-10 days.   Then ... nothing.  A couple of them said it would take longer because I used a credit card for the purchase.  One customer service rep said I'd been more patient than he would be and that I should go to my credit card company to request the remaining refund.  The whole process was very disturbing.

and by the way.  I did receive the remaining 25% of the refund from the credit card company.

I'm not sure of the details, but I believe Top-Rated Sellers that offer certain return terms (30 days?), can refund just a portion of the original purchase if they claim the buyer did not return in the original as-sent condition. I  would bet this is what happened here.

varebelrose - Very helpful thank you.  Only thing I remember that would contradict this is that he does not accept returns.  That was the first thing he said when I started the claim.  I found the whole ebay return process to be very confusing.   "seller does not accept returns, but if there's a problem with the item you can request one anyway."

...for INAD case, under MBG eBay policy, buyers entitle to the whole refund...

 

...I think only Top-Rate-Plus, not Top-Rate sellers could deserve that allowance...but again, this is an INAD case...perhaps eBay giving out from their own pocket for the remaining refund cost...?

...if eBay rolled out the MBG policy to satisfy buyers then eBay should not make buyers running around like chickens with their heads chopped off...eBay must fulfill their promise by quickly process the refunding money when the INAD case was found in buyer's favor...

 

...I empathize with your tremendous efforts in recovering your loss...no wonder this matter left you a bad taste in online shopping on eBay...but give the rest of us, the other sellers, a chance to make up the shortfall...

     Oh my, well please don't write off eBay because of this guy. You stated seller deals with electronic items not trains, well there you go. Please review your sellers more carefully next time. Items such as electric trains IMHO, should be bought from someone that knows a thing or two about...well trains.

    The packing alone on these trains has to be advanced as they can easily break as you seen with your item. Really sorry for this bummer of a sale, block this guy and find a good seller of choo-choos.

The most troubling thing of all was that every customer service rep I spoke to assured me that I was owed the full refund and had done nothing wrong.  Yet, I still never received the remaining amount through ebay.  That's the part that really sours me on the whole process.   One guy said, "for some reason it is getting stuck."  Maybe that sticking point was his ability to limit the refund and ebay didn't want to pay out from their own pocket as you said.  I still find it difficult to believe that the customer service reps would directly lie to me.  I would expect them to tell me why I couldn't receive the full refund.   Every one of them assured me I was due the refund.

 

It's disheartening to deal with a seller who is so dishonest.  My wife has sold stuff on ebay before.  One item never arrived because of this whole problem the USPS is having.  We immediately issued a refund and went to the USPS for insurance.   One lesson I learned is to look at the seller's other items.  If this item isn't like what they usually sell or their site looks like a flea market, maybe I should avoid it.
