Hello eBayers,
Just trying to get clarification on a current issue I had. I won an auction on a Friday, when I went to pay for the item, there was an issue with the card I was using through Paypal. I had to address the issue with my bank on Monday. Seller sent me an invoice and opened up a non-payment case on Sunday. I sent the seller a message on Monday which he/she said they did not receive to let them know the issue. The case said I had until Thursday to make payment. My issue was fixed on Tuesday and when I paid for the item on Wednesday the seller refunded my money saying the item had been relisted and was already purchased and shipped to another buyer. Seller said he/she needed the money and after getting no response from me, he/she relisted the item. After a little digging I find the item was relisted on Monday and bought on Monday. I'm confused as to the conditions of the case since the only way to alleviate the case is to pay for the item but the seller can then relist the item during the case period and sell it to someone else? I did contact the seller who kept saying he/she needed the money and he/she didn't have the item anymore so there. I'm a little bitter and would like clarification on the "case" regulations and why a seller can just sell an item you won while you are arranging payment within the stated timeline. Any information would be great, thanks.

The seller should NOT have relisted the item. His need for fast money does not outweigh your right to pay for the item at any tie before the unpaid item claim is closed.
IMHO you should leave feedback that expresses your disappointment, as a warning to potential future bidders.

I'd also report the seller to Ebay for not following policy. We don't need sellers like that selling here as it puts a stain on all of us.
If anyone can tell the OP where the report seller button is - I'd appreciate it as I would normally call myself but they may not want to waste the time.

What exactly is the OP going to report? The seller earned a defect by cancelling; the OP can leave negative feedback. What else is there?

Since you haven't left feedback yet, have you checked the seller's feedback profile? What she did sounds like an inexperienced or new seller mistake, to not wait until the Unpaid Item Dispute (UID) had closed before relisting the item.
If you find they are inexperienced I would suggest a neutral or no feedback, since ebay is already punishing them with a defect.
If they are experienced do not mention the UID in any way, or the feedback could be removed if reported.
How did you message the seller? Did you send the message throug ebay messages, or to their personal email? If it was to their personal mail, they may not have recognized your address and trashed it thinking it was spam.

A seller who files an unpaid case on Sunday for a transaction that was on Friday doesn't sound like a newbie to me. Easy enough for the OP to check on that.

How do you know the seller cancelled the transaction ?
The op has only stated that the seller relisted the item and sold it...

But one that opens the case, then relists the item before waiting out the case does.
We don't really have the full timeline or information on the seller though, so all we can do is postulate.

the seller refunded my money saying the item had been relisted and was already purchased and shipped to another buyer. - My bad - I assumed since the seller refunded the money - he cx the transaction

Not new but maybe new to selling. Were you refunded? If not open a not received case after the last delivery date to get refunded. Leave honest feedback and star ratings.

If they don't ship and you win an Item Not Received case, yes they will.
