Receiving an item not bid on.

I bid on a cape coat and seller sent a pair of pants.  I sent a message asking them to look into it.  The seller replied they were sorry, embarrassed and would send a return label.  Never did, so I opened a case up with Ebay.  Ebay found in favor of the seller.  I appealed with photos and the label of what the seller mailed to me.  Ebay still found in favor of the seller.  Now I have a pair of pants 4 sizes too small and very upset that I didn't receive the coat I was very much looking forward to receiving.  Anyone have a thought or help in what they would do, now?  Thanks... upset.

Exactly what kind of eBay case did you open? It should've been an ITEM NOT AS DESCRIBED CASE, not an item not received case and had to be opened within 30 days of receipt of the item.

Since eBay, unfortunately, offers just one bite of the MBG apple, you will now need to seek help from your credit card company.

If you stated "doesn't fit" as the reason for the return eBay considers it a remorse return. The correct reason would have been "not as described in the listing". It's an aspect of eBay's return policy that I consider to be not explained well. But as stated, your option now is to go to your payment source.

eBay always allows a buyer to return the wrong item so you either waited more than 30 days to open a not as described case or you opened a not received case instead of a not as described case.  Another reason the seller wins is they don't resolve the case and the buyer waits more than 21 days to escalate the case after opening it.

@lsskier You have been doing this for some time and should understand how the eBay MBG works and protects you. If this was your first issue with problems from sellers i think many would understand choosing the incorrect reason for return. Take a minute to read the eBay MBG so this does not happen again to you. Yes, it is unfortunate that you received something that you did not purchase but it is your responsibility to select the correct return dispute. The seller should have helped you out but that is why it is important to fully understand how to protect yourself. 

 

At this point you do have the option of contacting your bank/credit card to possibly dispute the charge. YMMV

Sounds like you opened the wrong type of case, it should have been Not As Described.

Contact your payment source and see if they can help.
