Question about an INAD already in progress

Hi, I filed a INAD 2 yesterday for an item that was, well, not as described. Seller does not accept returns. The seller responded to my request stating they do not accept returns and that the item is fine and that was it. So I assume she has declined the return? The item is not fine. She did not disclose some damage thus the reason for INAD.

At this point do I just wait for ebay to step in or do I reach out to ebay for my next step ? I have been buying/ selling on ebay for a long time yet I am not versed in this area. I don't want to go the route of an Amex charge back but I will if I have to.

No, eBay will never automatically step in, less work/headache/loss of money for them.  You need to contact them thru the case.

 

To be clear since you said technically you did hear from the seller.......what it means to hear from the seller is that...

they issued a return shipping label

they decided to refund without need for returning

they offered you a replacement and you accepted it

they worked something out that you are both in agreement of

 

not just that they responded in some form. 

 

If on March 25th, the seller has not sent you a return shipping label or refunded you (which you would get an eBay message regarding either), go to the case and ask eBay to step in.  They may issue a return shipping label or they may just make a decision and find in your favor and refund you without you having to send the item back.

 

The seller is aware that you opened a case, they also have the information that on March 25th you can escalate the case, no need to contact the seller again, leave it up to them to take the steps to rectify this issue and if they do not, on March 25th ask eBay to step in to do it for them.

If you filed an INAD then there should be a date in the message from eBay stating something like

 

The seller should respond and let you know what to do next.  If you don't hear back or can't work things out, you can ask us to step in and help starting on March........

 

So if the seller does not provide you with a shipping label or refund you, make sure to go back to that message or to the resolution center on that date and escalate the case to eBay.  Don't wait for eBay to step in, they won't without you escalating it.

 

*edited to include* also, if you ship it back make sure the tracking number is uploaded to the case, I would also keep a copy of the shipping label until it's resolved.

Always makes me laugh when I hear of a seller refusing a return on a damaged item. I'll bet if they were the buyer, they would expect a refund. You can ask eBay to step in after the date shown on the case. Everything you need to know will be in the case itself. Just follow the prompts once the time has passed, only a few days. You will be fully refunded once everything is completed. Best of luck to you....

Thank you both! She responded but only with a message so I wasn't sure if that meant that I technically I heard from the seller. But it sounds like I need to hear if she will accept the return or not. So, if she declines the return then ebay will automatically step in or do I need to then contact them?

My date is March 25th.

Ask eBay to step in as soon as you're allowed to do so.

She responded to you, not to eBay. So in eBay's eyes she hasn't responded until she either 1) sends you a return label or 2) simply ignores the case. Ebay waits three business days, to the minute, for the seller to send you a return label. If she doesn't, you'll then have the option to go back to the case and ask eBay to step in. That step is not automatic, so make sure you don't miss it. After you ask them to step in, eBay will send you a return label, and once tracking shows the return delivered to the seller, you'll be refunded.
