Purchased Item that was never received.

I bought Apple headphones and I received a notice that the label had been printed but in tracking the label has never been scanned.  The last delivery date that I have received was today Feb 18.  The headphones are not here.  The seller will not contact or answer me.  I tried going through Ebay but was just sent in circles.  These are the 3rd pair I have tried to buy and I still haven't received the refund on one of those.  They were to be present for my husband for Valentine's Day.  Any suggestions on what I can do now?  I really don't want to be out more money on this.  Ebay was never like this before.  Suggestions please.

Open an Item Not Received case.

If today was the last estimated delivery date you can't open an item not received case until tomorrow. Then you just need to go to the item in your purchase history and click 'I didn't receive it' under More actions.
