I received defective and stole headphones from the seller and requested a refund. The seller offered $50.00 and I keep the item. I declined. Now I want eBay to step in and the won’t allow me to file a claim. Because you have taken it out of my purchased items. I don’t want the item because they don’t work and they were replaced by Apple Support and take out of there system. There’re property of Apple. Please help! Thanks

Open a Return citing 'Not As Described'. You'll get a full refund from your seller.

Your first step is to file an item not as described case. 

 

After you open a case the seller is required to send you a return mailing label.  You will most likely go back and forth.

 

Once you receiv the mailing label you will need to send the item back and make sure the tracking information is loaded to eBay. Once the tracking shows that the item has been returned to the seller, you will receive your full refund.

 

If the seller doesn't send you a return shipping label, after so many days eBay will allow you to ask them to step in. Once they step in, they will most likely side with you and give you a refund. 

 

Whatever, you do during the case, don't close the case until you receive your refund and are satisfied.

It appears eBay has removed the listing from the site, so the OP can't file a claim with eBay.

If you paid for the item with PayPal, you have 180 days from the date you bought it to file a dispute based on the item not matching the item description.

 

How to open a dispute
  1. Log in to your PayPal account.
  2. Open a dispute in the Resolution Center within 180 calendar days of your purchase.
  3. Click “Dispute a Transaction.”
  4. Select item dispute.

If ebay removed the item you should have received a message on how to proceed to get a refund.  If the transaction took place over 60 days ago and timed out of your purchase history, you can expand the time frame of purchases from the default Last 60 days, by using the drop down arrow and clicking on 2020.

If you had to pay Apple for the replacements, that is one thing and getting a refund through eBay may not be possible. If Apple sent you a replacement pair for free why do you feel you are entitled to a refund?  That sounds like double dipping to me. 

 

If Apple charged you, you may have to go back to their support system and request a letter from them stating that they have received the "stolen/broken" headphones back, and sold you a replacement pair.

 

  With that you can try contacting ebay by phone using the Help & Contact button at the bottom of any ebay page, Request a call back, and explain the situation to the rep and ask if you can send a photo or scan of the letter (as long as it has been less than 30 days since the original stolen phones were delivered with tracking).  If you are outside of ebay's 30 day time frame, you can try getting a refund through PayPal though you will need the letter from Apple, Since PayPal requires return of the item as a condition for getting a refund.

 

  Your last resort would be, if you paid using a credit card, to contact  your card provider about doing a charge back, by calling the number on the back of your card. They too will probably require that you provide some form of verification that you've received stolen property and have sent the phones back to Apple.
