Issues with Seller, Should I allow extra time for Holiday?

Won and paid for an auction on November 16. The seller sent a message that they had just returned from being out of the country but would send the items either Monday or Tuesday morning at the latest which was the 22nd. Late on Tuesday, I messaged and asked the seller to provide the tracking as soon as they had it. No response. Order details state the deliver by date was November 25 but we just had a holiday. Should a allow an extra day before calling in eBay? Seller has zero feedback as this is their first listing.

You have 30 days from the last estimated delivery date to open a case. If it were me I'd give the seller the benefit of the doubt and wait a couple more days to see if they upload tracking.

Hi @gyregimble

First, you don't "call in eBay" ... what you do is wait one day past the original delivery date and file an Item not received claim.  Seller is given about 4 days to produce an active moving Tracking number ... if that does not happen within the allotted time for the Seller you go back to the claim and use the Ask eBay to step in feature, they will close the claim in your favor and refund you.

Frankly, I have no sympathy for the seller. He ran an auction knowing he would be out of town until almost a week past the closing date? That is just (OK Bot - take your finger off the button. I know that if I say what I really think I'll be suspended again for incivility. But then again, I did just say it, didn't I?).

File your INR claim now.

It won't hurt to give the item just a little longer to arrive.  You have 30 days past the last estimated delivery date to open an item not received case with eBay.  And you do not call eBay.  The MBG offers you plenty of protection.  All you need to do is open a case.

1) Thoroughly read the eBay MBG (money back guarantee) policy.
https://pages.ebay.com/ebay-money-back-guarantee/

2) Once the estimated delivery date shown to you has passed, File an INR (Item Not Received) case. It must be done within 30 days of this date. This is done through the website; there is no "calling in".

3) Seller will have to refund unless they can provide a valid tracking number that shows delivery. It will take X amount of time.

4) Pay close attention to timelines and steps during the case, and ask eBay to step in at the appropriate time if seller has not refunded yet.

Do not communicate with the seller any more except via the case.
It is possible that they may try to string you along, until enough time has gone by that you cannot file.

@gyregimble,

 "Seller has zero feedback as this is their first listing" .

The fact that your seller has (0) feedback, is probably why they have not shipped. They did not read far enough into the new seller info to find out that all new sellers have a 21 day hold placed on their first few payments, which is not an uncommon problem with new sellers. The Payment hold is also placed on sellers who have not sold anything in over a year, when they start selling again.  Another reason why you should check the feedback profile page of any seller you consider buying from. They may not have responded to your last message, because they still see your payment status marked as Pending on their account page, and think you may be trying to scam them.

Try messaging your seller again, and ask them to do a Google search for "Payments on hold, ebay". If they do that they will get the info on how to complete the transaction, and get the funds released.  They will probably ship your item shortly after they get your message.

Chatted with eBay, they initiated a case and the seller finally messaged to say, they had just returned from being out of the country (again) and the person who was suppose to ship did not. They provided a tracking number and today the box arrived but was not what the auction describes. The auction title and description say 2 in hand and the auction image shows two items. The seller shipped one item. So, back to eBay, now the seller is accepting a return despite the auction stating that they did not accept returns. Waiting on a label.
