I ordered a set of 4 plastic bins from the seller. She sent me a small box of candy! I contacted Ebay and they said since it shows it has been delivered, the seller will likely win the case. Unbelievable! I am now trying to contact an Ebay agent but is there any further steps I can take? I don't want that thief of a seller to get my hard earned money!

Yes, indeed, If you do "item not received" you would lose
Open a return.
Choose as "not as described".
Seller will need to provide a return label, or refund.

Did you open up a "not as described" case, or an "item not received" case?
If you opened an "item not received" case, you may be out of luck, since the tracking information shows that SOMETHING was delivered, and that's what eBay goes by.
On the other hand, if you had opened a "not as described" case, you would have been able to get your money refunded.
So which case did you open against the seller?

If they said the seller would most likely win because tracking shows delivered you must have opened a not received case. Not received means nothing was delivered.
Since you received the wrong item the proper case is Return this item. Select wrong item
or doesn't match or not as described as why you want to return it for a refund.
I don't know why eBay didn't explain that to you.

Thank you everyone. Got a hold of an Ebay agent and he had me close the 'not received' case and opened a return instead. Hopefully all will go smoothly. Appreciate the replies!

Is this something new -- an eBay agent who is able to change an "item not received" case to a "not as described" case?
I've never heard of this ever happening before -- sounds more like an eBay agent trying to get the OP off the phone.
Anybody know if eBay can make this change?

Anyone can open a return case after an INR is closed. Nothing new about that.

CS didn't change it, they just told the OP what to do.

It should also be pointed out that there's never a need to talk to an eBay agent to open a case. You can open cases from your purchase history. The process is simple and fully automated.

Just to clarify, Ebay CS had me close the previous case and helped me reopen the return. Appreciate the helpful comments on here. Now the seller is coming back saying the tracking number is not the same as the one I pictured. I resent a picture of the label showing that it is indeed the same tracking number. I have heard of this scam before, mostly from Chinese sellers (which it appears this person might be). Just shameless!

Don't bother replying to your seller. Just wait for the SNAD claim to play through; you will either be given a shipping label to return the incorrect item, or be reimbursed for it directly. Return the bum item with the shipping label if you get one, and don't listen to anything else the seller says. Pay close attention to any timelines ebay gives you so you get your money back.

Ignore the seller now, go back to the INAD case you opened in 3 days and ask eBay to step in to force the refund
