You had 30 days from the last estimated delivery date to file an item not received dispute, using the Money Back Guarantee (MBG) which expired on Nov. 12. All you can do now is to file with PayPal who gives you 180 days to file disputes, if you use that service or with your card provider if you used one.
You should definitely read the terms and time frames of ebay's MBG, You should also check each seller's feedback profile page before buying from them. You can get to that page by scrolling to the bottom of a listing page where you see the seller's username in a large font. A little below that is a
( See All Feedback ) button. click on it and on the page that opens check the seller's country of registry. Below that there is a box with the numbers of the 3 types of feedback a seller can receive.
You can click on the numbers of negative and neutral feedback to read only those comments. NEVER go by a seller's feedback percentage alone. If you see that a seller giving a U.S. location is registered in China, I suggest not buying from them. Also avoid buying from high volume sellers with less than a 98.6% rating.

1- The seller is registered in US. The package seemed to be coming from China. I know that drop-shipping is common. No red flag to me.
2- I didn't know that the product would come from China until after I paid and that was processed. Not uncommon for drop-shipping.
3- The EBAY system did not sync or update its deliver time with the tracking. It created its timing from assuming the item be shipping within US.
4- I filed the item not recieved within 29 days after the the last possible date of the US assumed arrival.

I’m in the same situation but I have 15 days left. I filled a report to eBay I’ll get a refund on the 27th. Did you end up receiving the item? If not did u get your money back?
