I purchased a name brand eyshadow pencil but was sent a cheap imitation from china instead.
In the offering it showed the name brand on the box. That is not what I got. I consider that fraud.
I will never use
ebay again.

If item that you paid for is not what you received request a refund. Contact the seller and tell them the situation, chances are they were not aware of this imitation item being in the name brand box.

Per your message here, you received an order that was not as described. Find this item in your Purchase History. In the drop-down menu, click on "Want To Return", then click on "Doesn't Match Description". You have just 30 days after receipt to open an NAD case with eBay.
After you open the case, you wait 3 days for a response from your seller. His options are: a) to send you a prepaid return label and then refund when he receives the item back; b) to just let you keep the item and refund you; or c) ignore the whole situation, in which case you return to the case and ask eBay to step in. You will be refunded and allowed to keep the item.

So you don't think that simply having the OP open an NAD case in order to be refunded would be a good idea? Nowhere in eBay's rules does it state that the buyer is required to contact the seller before opening a case.

This is NOT just an eBay problem. It happens on the other online sites as well. It is a known problem that happens especially with cosmetics. Loads of counterfeits! A few months ago, I ordered a lip balm/lipstick on another site & the box in the picture looked like an exact replica of the genuine brand with the "name' right on the box.
But when it came in the mail, I knew something wasn't right. The placement of the letters was a little off. Sure enough it was a fake. It fooled a lot of other people besides me as there were many bad reviews. You have to be very careful when ordering cosmetics online, on eBay and everywhere else as well. But as others here have said, you can just open a case & get a refund.
