Digital code not received and eBay won’t help!

Hi

I pre ordered a digital code for forza horizon 4 on eBay on the 26th of August 2018 and it still hasn’t arrived! The reason I’m this late in putting this incident on the forums is Because I’ve tried every other option and I never really thought that the forums would be able to help my problem. As I mentioned before I’ve tried everything else (trying to contact him, reporting him, contacting eBay on@askebay who seemed to ignore me after a few messages and even contacting my bank since I did the purchase on credit card) and none worked.

Does anybody know what to do about this? I really need the game and my parents won’t let me buy the game again! The reason I bought the code through eBay is I had to keep my purchases under $100 and this pre order was $10 cheaper than on the Xbox store😅!

@sujtissaa_0,

"The reason I’m this late in putting this incident on the forums is Because I’ve tried every other option and I never really thought that the forums would be able to help my problem".

It is too bad this happened with your first purchase, and that you waited so long to come to these boards for help. I think even the time frame for your last option at getting your money back has lapsed as well.  We can help with most issues, however this one has no good solution for you.

"I pre ordered a digital code for forz a horizon 4 on eBay on the 26th of August 2018 and it still hasn’t arrived"!

Unfortunately, the purchase does not qualify for either eBay or PayPal protections.  You cannot prove to either company with 100% proof  that you did not receive the code, so they will not cover you.

eBay gives you 30 days from the last estimated delivery date to file an Item Not Received (INR)  dispute, but that only covers physical items.

Paypal gives you 180 days from the date of payment to file an INR, but they too only cover physical goods.

If the payment was backed by a credit card. The card provider may cover you, but it is doubtful because you cannot absolutely prove you did not receive the item.  Not only that but the time limit a card gives for INRs may have lapsed already.  You would call the number on the back of the card to find out about that.

You made several mistakes with the purchase.

  1) purchasing a pre-order item if it was not to be released within 30 days of the listing end date.  Those types of listings are not supposed to be posted, but ebay cannot check every single listing. There are too many to do that.  There are protections for pre-order listings, but not of digital pre-orders.

https://www.ebay.com/help/policies/listing-policies/presale-listings-policy?id=4252

2) purchasing a digitally delivered item, that did not have a physical back up, such as a letter sent with the code and tracking information. Also there is almost no way to find out if a seller legally has the right to sell a digitally delivered item such as codes, music, e-books or other digital items.  (digital item policy link below)

https://www.ebay.com/help/policies/prohibited-restricted-items/digitally-delivered-goods-policy?id=4...

3)  You did not read the terms of ebay's Money Back Guarantee (MBG) or PayPal's buyer protections, before buying on this site.  Both of those can be looked up online.  the link to ebay's (MBG) is listed below

https://www.ebay.com/help/policies/ebay-money-back-guarantee-policy/ebay-money-back-guarantee-policy...

You posted the seller's name, but that will be removed by a mod, because you are not supposed to do that.  I checked different spellings of it, and they are not listed, at least on the U.S. site, which is where this topic is posted. If they were a scammer they may already have been removed.

In the future if you have questions about a listing or a problem with a transaction, do come here and ask us.  We can and do help people with problems before and after sales.

This is not true. It is incorrect. Paypal has covered intangible goods since 2015.

https://www.paypal.com/uk/webapps/mpp/merchant-intangibles-update

https://www.angelleye.com/paypal-buyer-protection-includes-digital-goods/

"Beginning on 07/01/2015, PayPal is extending the Purchase Protection program to cover “intangible goods.”  This includes services and digital goods like online music, e-books, games, travel tickets, and software downloads.

If a customer pays for a service or digital product using PayPal and it’s not received or is significantly different from how it was described, they can now file a buyer protection claim.  These types of transactions were simply not previously covered."

You have 180 days to file a claim in Paypal for an item you didn't receive. According to calculations, this is about day 167. I'd file the claim right now. I have no idea how they will adjudicate your case, but it's worth pursuing.

Good luck.

I did actually contact PayPal by their Twitter (@askpaypal) but their response seems automated and they won’t help!

File a claim within your PayPal account. Go find the transaction in Paypal for the purchase you made and select open a claim.

As others have stated..there is no buyer protection at Ebay or PP for digital items.
