Certified refurbished laptop - missing original accessories

I bought a laptop listed as "Certified Refurbished" from a seller with a 97.8% rating. From the listing, it says that items listed as Certified Refurbished includes...

  • Packaging: Comes in new, generic packaging with original or new accessories (if applicable).

I opened the box and the laptop is in brand new condition and came with power cord, but the laptop sleeve and stylus which are included with every laptop of this model were missing. I messaged the seller directly within minutes of opening the package and let them know, with the request to send the two missing items.

They responded with,
"Thank you for the message. Unfortunately, recertified units doe not come with its original accessories. The recertified units only come with the charger as an accessory."

I have responded letting them know this is contradictory to the policy and is not explained anywhere on the listing and am waiting for a response. Am I in the wrong? All I find when researching "Certified Refurbished" is that it should come with the accessories included at original purchase. If not, how do I escalate this to get a partial refund?

Return it for a full refund through eBay’s Money Back Guarantee. 
Click this >> Returns, Items Not received, and refunds for buyers. To learn how you return an item that is not as described. 
I wouldn’t haggle with that seller. I also wouldn’t count on a partial refund. Open a return case citing doesn’t match pictures or description and get ALL of your money back.

Use the link provided by ebooksdiva, to learn how filing for returns and refunds works. Given the seller's feedback percentage which is a poor one by ebay standards, skip the part about contacting the seller, since you have already done that.

 

 

When you file the dispute, it will appear on your My ebay Summary page and the seller will have 3 working days to respond to the dispute by sending you a return shipping label. Any messaging should appear in the dispute,  If you receive messages that do not appear in the dispute ignore them, they will likely be attempts to stall you past the time frames for asking ebay to step in.  If they do not respond on day 4 you can ask ebay to step in. 

 

As a new member there are at least 2 things you have to know about.

 

A)  the terms and time frames for using ebay's money back guarantee (MBG). Open the link below and from the list on the left side of the page click on the When the item received by the buyer doesn't match the listing button.  Save the link for future use.

B) How to check a seller's feedback profile page.  Near the bottom of the listing page you will see the seller's Username in a large font, below that will be a few recent feedback comments and below them is an oval with See all Feedback written in it.  Click on that to be taken to their feedback profile page.

On that page if the seller has received negative or neutral feedback, you can click on the numbers of those, to read only those comments. FYI the best high volume sellers will have a feedback percentage of 98.6% or better. You should avoid buying from sellers who have a lower percentage.  If a seller is registered in China, but gives a domestic location be wary and check their profle no matter how high of a percentage they have.

 

It takes some time to learn how to use ebay because you are dealing with individual sellers from around the world. Some things to watch out for are: 

Sellers who have US in their name and use American flag symbols on their listings. 

Sellers who do not give a city and state as the item location. New Jersey, United States is not acceptable. 

Information in listings that do not sound like they were written by a person whose 1st language is English.

In your case; the use of stock photos for an item that is used or refurbished.

Conflicting info between the Item Specifics, and the item title and/or the description.
