EBay calculates sales tax based on the tax laws of the state that the item is shipped to.

Slight clarification to what @rock.star commented: it's based on the tax laws of the state where the purchase is being shipped (so if you're the seller, @spinagain4u , it will not necessarily be based on the laws of the state you're in, it all depends on your buyer).
