If you are the seller, you need to cancel the order using the reason Out of Stock and fully refund your buyer.
If you are the buyer, your seller needs to do what I said above.

Okay thanks for your help. I've never had to get a refund on e bay but , if it's not in stock ....
Why pay for something when it's not there.... Anyway I really appreciate your help.

There is no reason to pay for it and your seller is responsible for tracking their own inventory and refunding you. I'm not sure why they haven't already taken care of you since they told you that they are out of stock.
