false tracking

I have bought an item three times from seller dls-tech. The item (304600678912) is a large box containing 6 plastic storage totes.  The first two times I was surprised by a very fast and unexpected Fedex delivery of the product that appeared to have come directly from Wal-Mart! This was followed by USPS first class tracking info on a small package that contained only a post card and another advertising card. This was  very odd and if I hadn't already received my product I would have reported the irregularity of the tracking. No tracking info was ever given on the FedEx shipments.

I received an offer from dls-tech for a discount on the item so I ordered it for the third time. This time I have received no Fedex delivery and only the tracked first class little package to my PO Box as before. I have not opened this one but it clearly just contains the same post cards as previously. I have opened a case with ebay but I am impatient to find out how they can get away with this and to stop them from whatever fraud they are committing. Also I have contacted the seller a couple of times whose responses were very vague. I need to find out how and why they are doing this and either get my product or a refund.

It is impossible to talk to an intelligent human being at ebay.

The seller is doing what is known as "dropshipping". You buy from them, they buy from Walmart and have it shipped to you. They are sending you the postcard so that they have tracking showing an item was delivered to you.

 

If you do not receive the third package, you will need to open a claim through eBay. Do not open a case for item not received because the tracking says it was delivered. You need to open a case for item not as described and explain what they did.

 

You may need to keep contacting eBay until you get someone who understands your situation.

Thanks for the input. Is this form of "dropshipping" allowed on ebay? It seems there is too much room for fraud with bogus tracking.

Sadly I already lodged a "not received" claim at ebay before seeing your post. Apparently I have to wait until the 15th before anything more can happen. I find it very disturbing and frustrating that we small sellers have to toe the line tightly about everything and big sellers can get away with all sorts of **bleep**. Like booksellers who don't post pictures and others who list the same item dozens of times with only minor changes to the listing, etc etc.

No, Ebay doesn't allow what that seller is doing.

Ok

To continue this thread...on the 15th ebay dismissed my claim and denied a refund! Needless to say  I am contesting the decision. In the meantime I have looked up the definition of Federal Mail Fraud. Using the US postal service to defraud this way definitely qualifies. I am wondering are there already any ongoing Class Actions suits against ebay and various sellers for this type of mail fraud? If not I am just mad enough to find myself a lawyer. I am only out about $60 but I am sick of this attitude ebay has!

Any info on any other similar cases or lawsuits would be appreciated. Feel free to message me directly.
