bad seller no consequence

i have a case open against a seller who has not shipped my item.  created a label, but status shows shipper awaiting item.   the day i requested assistance from ebay i got an email from ebay saying seller has updated shipping status.   i see no change in shipping status.  seller has not responded to daily and polite 3 messages.  what will happen is i will probably get a refund.   which means i can't leave any negative feedback of seller.   which seems sooooooo wrong to me.   is there a way to give negative feedback after receiving a refund?   it seems only fair since buyers must pay quickly...but sellers can just do whatever????/

There is no need being nervous. Buyers are protected by the eBay Money Back Guarantee. They can request a refund if an item doesn’t show up. Some sellers may also be able to send you a replacement. If you buy internationally with a long delivery period, a replacement is not a good idea.

 

First, check if the latest estimated delivery date has passed.

 
Then you have maximum 30 days to report the item you didn't receive. Three business days later, you can ask eBay to step in, if it’s still not solved.
 
So, it's a two step procedure.
