I purchased an item on Nov 23rd. Due to Christmas I have only just got around to trying to use it and have found that it does not work. I submitted a return request.
Immediately I got a response saying "The seller declined the return request".
When I try to query it through ebay help it just says "This case is closed. The decision is final and can't be appealed."
Why is this? What can I do?

You had 30 days from the date the item was delivered to file a Not As Described dispute through ebay. If you let that time frame pass and you paid with a credit card, you can try contacting your card provider to see if its protections will cover you. You will likely have to pay the return shipping with tracking, for the item your self, in order to do a charge back.
In the future do not let that time limit pass no matter how busy you might be.
FYI. While you are located in the U.K. you have posted on the U.S. based site's community (ebay.com) In this instance the U.S. and U.K. Money Back Guarantee policies are the same, but some of the other policies do have differences. In the future make sure you are logged into your home site (www.ebay.co.uk) when using the site or its community.
