I didn't receive an item but the tracking number shows that I received it, but it's not true, I contacted to seller and he told me he can do anything because tracking number says yes, so I decided to call shipping company and they told me that I'm not available to open claim because is the responsibility of the seller open it. So now I don't know what I have to do.

The carrier can check where the item was delivered. Ask proof if it wasn't your address.
Start a claim for an item not received and appeal the automatic rejection.
