When a seller files a Returns Request with the reason Not as Described, as long as you refund the buyer upon receipt of the item, there is no defect. A defect is only recorded when you don't take care of the problem and the buyer clicks Ask ebay to step in, and then ebay will refund the buyer and not require return of the item.
