Seller with all negative feedback and still on E-bay

I was in a hurry and saw an item that was an attractive price.  My mistake, and I  did not check the sellers feedback,  It was all negative in the last 6 months.  Also, the seller does not allow returns, and I  went to cancel it and it was  not even shipped yet.  I have attempted to contact the seller, but my messages get unanswered. I asked  E-Bay to step in and they said if I did not get a refund from the seller in 5 days to contact them again. I explained that there were no actions allowing me to cancel.   Why does E-Bay continue to allow sellers like this to still have an account  with not being able to ship and , refund and answer buyers?

Buyers can only REQUEST to cancel.  It is up to the seller to file the cancellation, and sellers are not obligated to do so.  If you do not receive your item by the estimated delivery date, when the item is at least one date late, you can file an Item Not Received case to get your money back.  The seller will have 2 days to either provide a tracking number showing DELIVERED or refund you in full.  If seller does neither, you go back to the case and click Ask ebay to step in.  It would appear that those buyers who left negs did not do this.
