Returning defective items outside of the return window

Hello eBay community, has anyone ever had any trouble with returning a defective item even after seller's return window has passed?

 

I had recently purchased some KYB rear shock absorbers for my 2007 Mazda CX-7 from an eBay seller (eeuroparts.com) and after installation of the shocks I discovered that they did not work and were defective right out of the box. I verified that the installation was done correctly but my car would easily bottom out over dips and speed bumps and even under moderate uphill acceleration. I then reinstalled the original shocks and although they were worn with 160,000 miles they still performed much better than these new KYB shocks which can only mean they are defective.

 

I contacted eeuroparts.com to see they would exchange the shocks for a working pair but their agent would only confirm that they were the correct parts for my vehicle and they would not offer any resolution because it had been 45 days after the purchase date and they have a 30 day return policy. I explained that I would have done this sooner but I had taken ill with a string of viruses and a bad sinus infection which had me laid up in bed for almost 5 weeks and i was unable to perform the installation as I had planned. I asked if they would please make an exception in my case because of this unfortunate situation which was beyond my control but they refused to help in any way stating they are unable to make any exceptions to the return policy.

 

I appealed multiple times but the agent continually refused and said he even involved managers and superiors but they all still stood behind the return policy and not me the customer. I can understand if I was trying to return for refund but I only wanted the seller to exchange them for another working pair of shocks which seemed only fair considering they sold me defective merchandise.

 

Has anyone else ever had a similar experience with a seller? Is there any other recourse for buyers in a situation like this? I am out $165 and can only throw these defective shocks in the garbage. Seems completely unfair to me that defective merchandise can be sold and buyers have no recourse just because of some arbitrary 30 days policy. Don't buyers have a right to receive value for their purchase?  Thank you!

@tcarnold1  not going to read your post, but if u r outside of the ebay return window, open a paypal case or dispute the charge, whichever is pertinent

@stuff4divas I edited with paragraphs but if you don't want to read what I posted that is your choice.

 

I did not use PayPal for the purchase so that probably won't help me.

 

I contacted eBay looking for help but their agent only said that I should post negative feedback and then report the seller.

 

I posted the negative feedback and tried to report the seller the way the eBay agent has prescribed but I could not move forward with it because the return window was closed.

 

Any other suggestions?

@tcarnold1  ok, so my suggestion remains the same, but since u did not use paypal, did u pay with a credit card? if so, dispute the charge.

Hmmm... I guess I could try that although it has been over 60 days now and I was the one that placed the order and I did receive the merchandise although it was defective.

 

I thought you could only dispute credit card purchases if you didn't make them yourself. I will look into this. Thanks

@tcarnold1   60 days should still be within the credit card dispute window.

 

and no, there are multiple reasons to dispute a charge and one of them is receiving defective merchandise.

 

the cc company and or your bank will want to see that you tried to resolve the issue first with the seller and or the company you purchased thru, in this case, eBay, and you did do that and you have proof with all the messaging you did.

 

they will want to see that and give the times you contacted the CS dept, if it was thru chat, u will have that as well, if thru phone, document the dates/times.

Also, i meant to post my original message in the main eBay community forum as informational as well as seeking advice. I thought others should know about this because this seller was/is a total a$$. 

 

This was my first posting and I didn't realize I had navigated to the "Ask a Mentor" forum until after I posted so sorry for my noobiness here and thanks for the advice.
